مبانی و اصول عدالت علوی در مواجهه با بزه دیده با تاکید بر بزه دیدگی ساختاری

از جمله مباحث مهم و مطرح در بزه‌دیده شناسی چگونگی مواجهه با بزه‌دیده است که بر حسب نقش و سهم او در وقوع بزه رقم می‌خورد و براین اساس رهیافت‌های مهمی را در عدالت کیفری رقم می‌زند. واکاوی این مهم در عدالت علوی که در گفتار و سیره عملی امام علی علیه السلام تجلی یافته موضوع مقاله حاضراست که با روش توصیفی تحلیلی انجام شده‌است. یافته‌های تحقیق حاکی از آن است که  اموری همچون اهتمام به کرامت انسانی، تامین  حقوق بزه‌دیده به عنوان  تکلیف الهی، توجه به بزه‌دیده به عنوان وظیفه اجتماعی و حمایت از بزه‌دیده گان مظلوم به مثابه یک ارزش، مبانی و واقعیاتی است که مواجهه موثر با بزه‌دیده را ضروری می‌سازد. از سوی دیگر این مواجهه باید بر اساس بایسته‌ها و اصولی همچون عدالت محوری، احسان مداری، مددکاری و ظلم ستیزی صورت گیرد تا اثربخشی لازم را داشته باشد.

foundations and principles of alavi justice in addressing victims: with an emphasis on structural victimization

one of the important and prominent topics in victimology is how to respond to victims, this matter largely shaped by their role and level of involvement in the crime. this assessment significantly influences approaches within the criminal justice system. the present article analyzes this issue within the framework of alavi justice, as reflected in the words and practical seerah of imam ali (as), using a descriptive-analytical method. the findings of the study indicate that concepts such as respect for human dignity, ensuring victims’ rights as a divine responsibility, paying attention to victims as a social duty, and supporting the oppressed as a moral value constitute the foundational principles that necessitate an effective and compassionate response to victims. moreover, this response must be guided by core principles such as justice-centeredness, benevolence, cooperation, and opposition to cruelty in order to be truly effective.
