حقوق بشر دوستانه در سیره امام علی علیه السلام

یکی از نکات مهم در جنگ‌ها رعایت حقوق زنان، کودکان، سالخوردگان و افراد ناتوان است که از آن با عنوان حقوق بشر دوستانه(humanitarian law) یاد می‌شود. سازمان‌ها گروه‌ها و افرادی در نقاط مختلف جهان تحت این عنوان فعالیت می‌کنند. شناخت جایگاه این قانون در اسلام و تبیین مفاد آن در سیره علوی از اهمیت ویژه‌ای برخوردار است. رعایت اصول جوانمردانه، خودداری از روش‌های غیرمتعارف در جنگ‌ها، حمایت از زنان و کودکان، حفاظت از افراد ناتوان و پیران و سالخوردگان و منع به‌کارگیری سلاح‌های مخرب از مهم‌ترین نکاتی هستند که در قوانین امروز بر آن تصریح شده و در سیره امیرالمومنین علی علیه السلام نیز مورد تاکید قرار گرفته و اجرایی شده‌اند.این نوشتار بر آن است تا با نگاهی به سیره امام علی علیه السلام به ویژه جنگ‌های عصر ایشان و بررسی توصیه‌های آن حضرت درباره گروه‌های ناتوان یا خارج از جنگ، راهکارهای امیرالمومنین علیه السلام برای حفاظت از آنان را تبیین کرده و به این پرسش پاسخ دهد که سیره امام علی علیه السلام درباره حقوق زنان، کودکان و افراد ناتوان دشمنان در جنگ‌ها که امروزه از آن با عنوان حقوق بشردوستانه یاد می‌شود چگونه بود؟

Humanitarian Law in the Seerah of Imam Ali (A.S.)

One of the important points in wars is the observance of the rights of women, children, the elderly, and the disabled, called humanitarian law. Organizations, groups, and individuals in different parts of the world operate under this title. Knowing the position of this law in Islam and explaining its provisions in the Alawite tradition is of special importance. Observing the principles of fairness, refraining from unconventional methods in wars, protecting women and children, protecting the disabled and the elderly and the prohibition of the use of destructive weapons are among the most important points specified in today’s laws and has been emphasized and implemented by Amir al Mu’menin. This article intends to study Imam’s seerah, especially the wars of his time, and examine his advice about the disabled or out of war groups, to explain the Amir al Mu’minin’s strategies for protecting them. It also aims to answer how the Imam’s seerah about the rights of women, children, and the disabled enemies (nowadays known as humanitarian law) was during the wars?
