نگاهی به الزامات موازین بین‌المللی حقوق‌بشر درزمینۀ حق بر آموزش کودکان مهاجر

کودکان از‌جمله گروه‌های آسیب‌پذیر انسانی هستند که براساس موازین بین‌المللی حقوق‌بشر لازم است حمایت‌های خاصی برای آن‌ها تدارک دید تا بتوانند به رشد و شکوفایی لازم برسند. در میان کودکان نیز برخی به‌جهت وضعیت‌های ویژه در معرض آسیب‌پذیری بیشتر قرار دارند. کودکان مهاجر و همه طیف‌های تابعۀ آن اعم‌از کودکان آواره، پناه‌جو، پناهنده، فاقد مکان، بی‌وطن از‌جمله گروه‌های آسیب‌پذیرتر محسوب می‌شوند. موازین بین‌المللی حقوق‌بشر برای رعایت حقوق این گروه در ابعاد گوناگون زندگی، احکام متنوعی را بیان داشته است. واکاوی جزئیات حق آموزش این گروه از کودکان و تبیین الزامات حقوقی ذی‌ربط که دولت‌ها و دیگر بازیگران در سراسر جهان باید رعایت کنند، محور اصلی بررسی حاضر است. به‌تبع محور یادشده، مروری بر تعهدات کلی کشورها در حوزۀ حق بر آموزش نیز انجام پذیرفته است. رهاورد این بررسی، ضمن تاکید بر اینکه هیچ کشوری دراین‌زمینه بدون انواع چالش‌ها نیست، معرفی الزامات حقوقی بین‌المللی درخصوص حق بر آموزش گروه کودکان مورد مطالعه است که می‌تواند برای سیاست‌گذاران و مجریان حاکمیتی و تشکل‌های غیردولتی کشور ما در جایگاه جامعه میزبان صدها هزار مهاجر، مورد بهره‌برداری قرار گیرد؛ خصوصاً که برای امکان بیشتر تحقق این مهم، برخی توضیحات دربارۀ نظام حقوقی ایران نیز درخلال بحث اصلی آمده است.

studying the requirements of international human rights regarding the right to education of migrant children
