حکم رمی جمرات در محدوده توسعه یافته آن از دیدگاه فقه اهل بیت (ع) و فقه حنفیه

فزونی جمعیت در قرون اخیر، یکی از چالش‌های مناسک اعمال منا است، از طرف دیگر توسعه‌های اخیر که در جمرات صورت گرفته است، ضرورت دارد که حکم رمی جمرات در محدوده توسعه یافته آن از دیدگاه فقه‌ اهل‌بیت(ع) و فقه حنفیه موربررسی قرار بگیرد، از این رو مقاله حاضر در سدد بیان این امر است، نظرات مخالفان و موافقان مورد بررسی قرار گرفت، از آنجای که تعین مواضع عبادت حج، از طرف شارع مقدس است و نظر عرف در اینجا اعتباری ندارد و توقیفی بودن مناسک حج و قاعده بین تخیر و تعین اعلام می‌کند که محدوده سابق باید رمی شود، اگر در محدوده توسعه یافته رمی صورت بگیرد، دلیل بر صحت حکم مشکل است، اگرچه موافقان برای صحت جواز رمی جمرات در محدوده توسعه یافته آن به صدق عرفی و اطلاقات ادله رمی جمرات استدلال کرده‌اند، که بعد از واکاوی؛ صدق عرفی در این مورد اعتبار ندارد بخاطر اینکه تعین مواضع عبادت حج به دوش عرف نیست، همچنان ادله رمی جمرات اطلاق ندارد چون شارع مقدس در مقام بیان محدوده جمرات نیست.اما در شرع مقدس برای این چالش راه حل‌فقهی در نظر گرفته شده است که عبارت از توسعه فاعلی و توسعه زمانی باشد. بنابراین رمی جمرات در محدوده توسعه یافته آن مجزی نیست، در صورت بروز مشکلات و مشقت های حاصل از فزونی جمیعت، باید به توسعه فاعلی و توسعه زمانی رمی جمرات توجه شود و به آن عمل شود.
