بررسی فقهی شرط احرام جهت ورود مجدد به مکه برای عمره‌گزاری‌که از مکه خارج شده

از آنجا که زائرین خانه خدا گاه برای انجام برخی امور پس از انجام اعمال عمره، ناچار به خروج از شهر مکه می‌شوند، این مسئله مطرح می‌شود که در صورت ورود مجدد به مکه، آیا لازم است محرم شوند یا اینکه بدون احرام نیز می‌توانند وارد مکه مشرفه شوند. آیا جواز ورود به مکه بدون احرام، فقط اختصاص به کسی دارد که ماه ورود مجدد او به مکه همان ماه اهلال (محرم شدن) او باشد یا ماه احلال (از احرام خارج شدن) و یا ماه خروج از مکه؟ آیا مقصود از ماه، ماه قمری است یا ماه عددی و 30 روز؟ آیا نوع احرام سابق (عمره تمتع یا مفرده و یا حج بودن)، تاثیری در حکم مذکور دارد؟ بر اساس پژوهش انجام شده، که به صورت توصیفی تحلیلی و بر مبنای اطلاعات کتابخانه‌ای است، باید گفت کسی‌که خارج از مکه مشرفه است، برای ورود به مکه مشرفه باید محرم شود، مگر در صورتی‌که یک ماه قمری از زمان اتمام عمره قبلی او نگذشته باشد؛ چراکه واژه «شهر»، در روایات انصراف به ماه قمری دارد و نه ماه عددی، و ملاک خروج از مکه در این مسئله، خروج از محدوده حرم است. همچنین فرقی نمی‌کند که احرام قبلی او برای عمره تمتع بوده یا عمره مفرده و یا حج. برای محاسبه ماه نیز، زمان خروج از احرام، ملاک است نه زمان اهلال (محرم شدن) و یا زمان خروج از مکه.

A Jurisprudential Study of Ihram Condition toReenter Mecca for an Umrah Performer Who Has Already Left the City

Since the pilgrims of the House of God need sometimes to leave Mecca for some affairs after performing Umrah, a question arises here that whether or not they need to become Muhrim to reenter the city. Is the permission to enter Mecca without Ihram is reserved only for those who reentered Mecca in the same month of becoming Muhrim, in the month of leaving Ihram, or in the month of leaving Mecca? By the month, does it mean a lunar month or a numerical one (30 days)? Does the type of the former Ihram (Umrah alTamattu, Umrah alMufradah, or Hajj) affect the said ruling? According to the present librarybased descriptiveanalytical study, whoever is out of Mecca must be in the state of Ihram to enter the city unless one lunar month has not passed since the end of his previous Umrah because the Arabic word “Shahr”(month) in the narrations refers to a lunar month and not a numerical one; and the criterion for leaving Mecca in this matter is leaving the area of the Haram. Also, it does not matter whether his previous Ihram was for Umrah alTamattu, Umrah alMufradah, or Hajj. To calculate the month, the time of leaving Ihram is the criterion, not the time of being Muhrim or the time of leaving Mecca.
