بازشناسی الزامات مدیریت و ساماندهی دست‌فروشان با تاکید بر حقوق شهروندی

دست‌فروشی پدیده‌ای اجتماعی، فرهنگی و اقتصادی است که در اغلب جوامع و نیز از گذشته تاکنون به اشکال گوناگون وجود دارد. این امر در شهرهای ایران نیز به دلایل عدیده مانند فقر و بیکاری در دهه‌های اخیر رو به افزایش است که با مسائل متعددی مواجه است. نابسامانی فضاهای شهری، سدمعبر، معیشت و نیازهای دست‌فروشان، خلا قانونی در رفع سد معبر بدون توجه به تبعات آن از مهم‌ترین مسائل مربوطه است. این پژوهش از نظر نوع تحقیق در زمره تحقیقات توصیفی- تحلیلی است و روش جمع‌آوری اﻃﻼﻋﺎت، ﻫﻢ ﺑﺮ اﺳﺎس ﻣﻄﺎﻟﻌﺎت کتابخانه‌ای ﻳﺎ اﺳﻨﺎدی است. در مطالعه حاضر در ابتدا واژه دست‌فروشی و حقوق شهروندی در کتب و منابع مختلف ارائه گردیده و در بخش دوم قوانین مرتبط در خصوص دست‌فروش و الزامات ساماندهی دست‌فروشی با تاکید بر حقوق شهروندی ارائه گردیده است. نتیجه تحقیق حاکی از آن است که پدیده دست‌فروشی مفهومی چندبعدی است که قوانین متفاوتی را شامل می‌شود و در این رابطه قوانین منسجم و مستقل وجود ندارد و قوانین موجود نیز با یکدیگر هم‌جهت نیستند و این مساله موجب بروز شیهه و شبهه در میان مخاطبین از این جهت که به کدام مفاد قانونی در رابطه با دست‌فروشی استناد کنند، می‌شود. مفاد قانونی مختلف درباره دست‌فروشی سبب شده که سازمان‌های مختلف، هریک متناسب با حوزه و منافع خود تفاسیر گوناگونی در این زمینه داشته باشند و حتی گاهی منجر به نادیده گرفته شدن حقوق شهروندی می‌شود که می‌بایست این حقوق رعایت شود. درحالی‌که نتیجه پژوهش‌های میدانی متغایر با این موضوع بوده و با تکیه‌بر گویه‌های دست‌فروشان بازار تربیت تبریز می‌توان گفت که مباحثی همچون عدالت، آزادی فردی، حق کار و اشتغال و در یک نگاه کلی حقوق شهروندی در خصوص آن‌ها رعایت نمی‌شود. تدوین قانون مستقل و منسجم و مجزا برای پدیده دست‌فروشی می‌تواند در جهت سامان دادن به دست‌فروشان کمک نماید.

hand-selling is a social, cultural and economic phenomenon that exists in most societies in various forms from the past to the present. this is also increasing in iranian cities for many reasons in recent decades, such as poverty and unemployment, whichis facing many problems. disorder of urban spaces, roadblock, livelihood and needs of peddlers, legal vacuum in removing the roadblock regardless of its consequences are the most important issues. this research is a descriptive-analytical research in termsof the type of research and its method is’s method. in the present study, at first, the term peddling and citizenship rights are presented in various books and sources, and in the second part, the relevant laws regarding peddling and the requirements for organizingpeddling with emphasis on citizenship rights are presented. the results of the research indicate that the phenomenon of peddling is a multidimensional concept that includes different laws and in thisregard there are no coherent and independent laws and the existing laws are not in the same direction and this issue causes suspicion and suspicion among the audience of this is to determine which legal provisions to refer to in relation to peddling. different legal provisions on peddling have caused different organizations to have different interpretations in this field, depending on their field and interests, and sometimes even lead to the disregard of citizenship rights, which must be respected. while the resultsof field research are different from this issue and relying on the statements of peddlers in tabriz tarbiat bazaar, it can be said that issues such as justice, personal freedom, labor rights and employment and in a general view civil rights are not observed. be. developing an independent, coherent and separate law for thephenomenon of peddling can help to organize peddlers.
