درمان ناباروری با استفاده از سلول‌های بنیادی زنان؛ پردازش فقهی

امروزه با گسترش دانش و فن آوری‌های نوین پزشکی، چالش‌های بسیاری فراروی فقه قرار گرفته است. یکی از این نوع مسائل که برای درمان ناباروری به کار می‌رود، استفاده از سلول‌های بنیادی بافت تخمدانی برای استحصال تخمک ژنتیکی از زنان نازا و در سنین باروری است. سلول‌های بنیادی، سلول های اولیه و مادر تمام سلول‌ها هستند که توانایی تبدیل شدن به تمام سلولهای بدن را دارند، و می‌توانند در ترمیم بافت‌های مختلف بدن و جایگزین شدن با سلول‌های آسیب دیده موثر باشند. با کشت سلول‌های بنیادی که در یک بافت تخمدانی وجود دارد، می‌توان به تخمک بالغ رسید و با استفاده از تکنیک ivf در بخش بالینی می‌توان برای درمان ناباروری به افرادی که ذخیره تخمک آن‌ها پایین آمده، کمک نمود. در این پژوهش، از منظر فقهی و با روش تحلیلى و اجتهادی به نقد و بررسی دلائل شرعی استفاده از سلول‌های بنیادی در درمان ناباروری زنان خواهیم پرداخت. پژوهش حاضر نشان می‌دهد با توجه به ناتمام بودن ادله‌ای که بر حرمت استفاده از سلول‌های بنیادی اقامه شده، می‌توان با وجود برخی شرایط، به جواز این عمل، حکم نمود و حتی این روش، نسبت به برخی روش‌های دیگر درمانی همانند اهدای گامت و جنین از اجنبی، که از نظر نسب و فروعات آن، مورد تامل و چالش است، از اولویت بیشتری برخوردار خواهد بود.

jurisprudential analysis of the treatment of female infertility with stem cells

today, with the expansion of new medical knowledge and technologies, jurisprudence has faced many challenges. one of these types of issues is the use of ovarian tissue stem cells to obtain genetic eggs from infertile women for medical fertility. stem cells are primary and mother cells of all cells that have the ability to transform into all body cells and can be effective in repairing different body tissues and replacing damaged cells. by cultivating the stem cells that exist in an ovarian tissue, it is possible to reach a mature egg, and by using the ivf technique in the clinical department, it is possible to help people whose egg reserve is low to treat infertility. in this research, from a jurisprudential point of view and with an analytical and ijtihad methodthe legality or illegitimacy of using these types of cells to obtain a fake egg from the ovarian tissue and its legal reasons will be investigated. the current research shows that considering the incompleteness of the evidences that have been established on the sanctity of the use of stem cells, despite some conditions, it can be ruled that this practice is permissible, and even this method is better than some other treatment methods such as gamete donation and a fetus from a stranger, which is considered and challenged in terms of its lineage and branches, will have more priority.
