مطالعه تطبیقی حق بر شیردهی و بر تغذیه با شیرمادر

شیردهی، رابطه‌ای دوسویه میان مادر و کودک است که ازیک‌طرف حقی برای مادر جهت تغذیه فرزند با شیر مادر ایجاد می‌کند و از سوی دیگر از جمله حقوق کودک است که متضمن مصالح عالی بهداشت وی و از منشعبات حق بنیادین کودک بر تغذیه است. بر این اساس لازم است از سوی دولت‌ها و جامعه‌ محترم شمرده شود. البته مسئله‌ چارچوب حدود وثغور حقوق و آزادی‌های طفل و مادر نیازمند تبیین است. اینکه آیا حقی به‌عنوان تغذیه با شیر مادر برای کودک وجود دارد؟ آیا شیردهی به طفل برای مادر حق است یا تکلیف‌ و آیا می‌توان مادر را از شیردهی به فرزند خویش منع یا او را به این امر مکلف نمود؟ آیا  سنخ دیگری از حق در رابطه عمودی میان دولت و شهروند در این خصوص وجود دارد.  این‌ سوالات در مورد حقوق مرتبط با شیردهی و پاسخ دهی به آن ها مستلزم  بررسی نقش دولت‌ها در حمایت از تغذیه با شیر مادر و وضع مقرره‌های حمایتی و استخدام ابزارهای تشویقی و نیز بررسی مقرره‌های حقوق خانواده در قالب نهادهای مرتبط است. نتایج این مطالعه که به بررسی تطبیقی نقش دولت در اسناد بین‌المللی و حقوق ایران و بررسی تطبیقی حق و تکلیف شیردهی در فقه امامیه و عامه و نیز  نظام حقوق ایران و سایر کشورهای اسلامی پرداخته، نشان می دهد حقوق و آزادی‌های بنیادین مادر، بر حق عادی کودک بر تغذیه با شیر مادر مقدم است،‌ با این‌حال دولت‌ها مکلف به رفع موانع در حوزه شیردهی می باشند.

a comparative study of the right to breastfeeding and the right to feeding with breast milk

breastfeeding is a two-way relationship between mother and child, which creates a right for the mother to feed the child with her milk on the one hand, and on the other hand, it is one of the rights of the child, which includes the child’s excellent health benefits and is one of the branches of the child’s fundamental right to nutrition. on this basis, it is necessary to be respected by both governments and society. the issue that occurs in between is how to explain and frame the limits of the rights and freedoms that the child and the mother have in this matter. is there a right for a child to breastfeed? is breast-feeding a child a right or a duty for a mother? these are the questions that arise from the issue of rights related to breastfeeding, and the answer depends on examining, firstly, the role of governments in supporting breastfeeding and establishing protective regulations and employing encouraging tools, and secondly, examining the regulations of family rights. this research, using a library method and with a comparative study of the role of the government in international documents and iranian laws, as well as a comparative study of the rights and duties of breastfeeding in imamiyyah and public jurisprudence, the legal system of iran and other islamic countries, has reached the conclusion that the fundamental rights and freedoms of the mother the normal right of the child to be fed with mother’s milk is overcome.
