کشف خلاف واقع در ازدواج

عقد ازدواج همانند هر قراردادی، شرایطی دارد که طرفین بر وجود و رعایت آن‌ها توافق می‌کنند. عقد ازدواج بیش از هر پیمانی بر صداقت استوار است. بااین‌حال بعد از وقوع عقد در برخی موارد مشاهده می‌شود که علیرغم توافقات انجام‌گرفته، خلاف آن کشف می‌شود. کشف خلاف واقع در عقد ازدواج، دارای احکامی است که شناخت آن‌ها برای زوجین و نظام تقنینی و قضایی اهمیت زیادی دارد. روش پژوهش حاضر توصیفی، تحلیلی و استنباطی است. گردآوری مطالب به شیوه‌ی کتابخانه‌ای است. یافته‌ها و نتایج پژوهش نشان داد کشف خلاف واقع بعد از وقوع عقد، حسب مورد آثار و احکام گسترده‌‌ای چون بطلان، بطلان عقد به همراه حرمت ازدواج بعدی (ابد یا موقت)، فسخ عقد ازدواج، اجبار به انجام تعهد، ادامه ی زندگی، تفکیک اقامتگاه، جبران خسارت، تقاضای زوجه برای طلاق، عدم نفوذ عقد، حق ابطال نکاح، مجازات، اجرای حدود الهی، ممنوعیت ادامه ی اشتغال را در پی دارد.
