زمینه‌ها و پیامدهای اخذ شرط وکالت زنان در طلاق

هدف این پژوهش واکاوی زمینه ها و پیامدهای حقوقی– اجتماعی اخذ شرط وکالت در طلاق برای زنان است. این پژوهش با روش کیفی و تحلیل تماتیک از طریق مصاحبه‌ی نیمه ساختاریافته با کارشناسان مرتبط انجام شد. نتایج مطالعه نشان داد عوامل درخواست اخذ شرط وکالت زنان در طلاق از منظر پاسخ گویان مواردی نظیر دشواری پروسه‌ی دادرسی، ناکامی های حقوقی، فردگرایی متورم، شکل گیری منیت در زندگی، قدرت طلبی، گسترش بی‌اعتمادی، ضرورت های اجتماعی، رهیافت متظاهرانه، ناامنی روانیاجتماعی و آینده نگری در زندگی است. همچنین نتایج پژوهش حاضر نشان داد، کاهش هزینه های طلاق، بازدارندگی از ظلم، زمینه سازی برابری، اعتمادسازی و امنیت آفرینی از پیامدهای مثبت و منیت و خودخواهی، کاهش اطاعت پذیری زنان، کاهش آستانه‌ی تحمل زنان در زندگی، کشاکش منفعت‌طلبانه، تصویر ذهنی منفی و زمینه ساز آینده‌ی نامطلوب از پیامدهای منفی اخذ شرط وکالت زنان در طلاق است.

Causes and Consequences of Obtaining aWoman’s Attorney in Divorce in IRAN

The purpose of this study is to analyze the causes and consequences of obtaining a divorce lawyer for women as a legalsocial issue. This research was conducted by qualitative method and thematic analysis through semistructured interviews with relevant experts. The results of the study showed that factors such as requesting divorce from women in terms of divorce are difficult to process, legal failures, swollen individualism, forming ego in life, empowerment, mistrust, social necessities, pretentious approach. There is psychosocial insecurity and futures in life. The results also showed that lowering the costs of divorce, deterrence from oppression, moral reinforcement, equality, confidence building and security, the positive consequences of selfesteem and selfishness, lowering women’s obedience, lowering the threshold of tolerance and destructive life expectancy, conflict. Profitability, a negative mental image, and the creation of an undesirable future are the negative consequences of obtaining the right to divorce from women. In sum, it can be said that the views of experts on the question of whether or not to apply for divorce, whether or not they wish, are in line with Islamic and feminist theories, while a few have an intermediate view that the balance of power will be fully attained by the wife.
