رویکردی فقهی به اصل آزادی در ازدواج از منظر اسناد حقوق بشری

بند الف ماده ی پنجم اعلامیه ی اسلامی حقوق بشر (قاهره) خانواده را پایه ی جامعه معرفی و مقرر کرده که زناشویی اساس ایجاد آن است؛ مردان و زنان حق ازدواج دارند و هیچ قیدوبندی که بر پایه‌ی نژاد یا رنگ یا قومیت باشد، نمی تواند مانع این حق آنها شود. حق آزادی در ازدواج، با اندک تفاوت ظاهری، در ماده ی شانزدهم اعلامیه‌ی جهانی حقوق بشر (1948) مطرح شده است. پژوهش انجام‌شده با روش توصیفی تحلیلی، مستند به بند الف ماده ی پنجم سند اسلامی و تفسیر آن به وسیله ی ماده ی بیست و پنجم همان سند، تامین حداکثری اصل آزادی در ازدواج را مبتنی بر سند و مفاهیم اسلامی به اثبات رسانده است. از نتایج مهم مطالعه ی حاضر، نگرشی نو به مفهوم کفویت موافق با اصل آزادی و همچنین یکسان‌دیدن این اصل از منظر اسناد حقوق بشری مطابق برخی تفسیرهاست.

Juridical View to Freedom Marriage in the Human Right Documents

Accomplished study, with a descriptiveanalytic method based on first paragraph of Islamic bill and interpretation by twenty fifth that same with to point juridical and legal sources of Islam to prove maximum securing about freedom in marriage based Islamic bill. One of the important results in present study, to unify freedom in marriage point of view human right documents according to some interpretation that state from it.
