ماهیت و آثار طلاق توافقی در فقه و حقوق

طلاق توافقی از وقایع نوپدید در حقوق خانواده است که طبق آن زن و شوهر برای طلاق و حل و فصل تمامی وابستگی های مالی و مسائل مربوط به فرزندان مشترک برای رجوع به محکمه ی خانواده توافق می کنند. به دلیل آثار متفاوت انواع طلاق ها در روابط طرفین، شناخت ماهیت آنها اهمیت ویژه ای دارد. این پژوهش با روش کیفی و با مراجعه به مستندات فقهی و حقوقی، ماهیت طلاق توافقی را بررسی کرده است. در طلاق توافقی، باید کراهت زوجه از زوج برای قاضی محرز شود؛ در این صورت، طلاق بائن و در غیر این صورت، حتی با وجود بذل فدیه، طلاق رجعی است؛ لذا قاضی باید کراهت زن از شوهر و یا ادامه ی زندگی با او را احراز و سپس، گواهی عدم امکان صادر کند. نظر به اینکه احراز کراهت زوجه و یا زوجین در نوع و ماهیت طلاق موثر است، شایسته است قضات محترم و یا سردفتران طلاق به این موضوع توجه کنند و پیشنهاد می شود رویه ی جامعی در این مورد در دستور کار قرار گیرد که در صورت محرزنشدن کراهت زوجه از زوج و یا زوجین از یکدیگر، طلاق توافقی صادره از نوع رجعی ثبت شود تا بر اساس شرع اسلام حق رجوع برای زوج باقی بماند، زیرا حق رجوع در مواقعی با بازگشت زوج، مانع از هم گسیختگی شتابزده ی زندگی می شود.

The Nature and Effects of Divorce by MutualConsent in Jurisprudence and Law

Divorce by mutualconsent (ma’aalevaz) is a new phenomenon in family law based on which couples come to an agreement to apply to the family court for divorce and settlement for their financial affairs and issues related to the children. Due to different effects different kind of divorces may have on couples’ relationship, it is particularly important to understand the nature of them separately. This study investigated the nature of divorce by mutualconsent (ma’aalevaz) qualitatively and by referring to legal and jurisprudential documents. In mutualconsent divorce, it must be confirmed that wife dislikes her husband; which makes it an irrevocable divorce; otherwise the divorce is revocable even if the wife paid considerations. Therefore, the judge should confirm wife’s disliking her husband or living with him and then, issue the certificate of incompatibility. Considering the fact that whether the wife dislikes living with her husband or both parties dislikes living together determines the kind and nature of divorce, careful considerations must be made in judicial as well as notary procedures of divorce. Moreover, this study suggests adopting a comprehensive approach in the proceedings of divorce so that in case it is not confirmed that the wife dislikes her husband or both parties dislikes each other, a revocable divorce be registered. In such cases, based on sharia, the right to revoke the divorce by husband is maintained, which prevents hasty dissolution of family.
