مبانی فقهی مسئولیت حکومت در برابر زنان بی‌ سرپرست و بد سرپرست

نظام جمهوری اسلامی ایران به عنوان شاکله ی اصلی و زمینه ساز تحقق تمدن اسلامی؛ ناگزیر از توجه نظام مند به تمام مختصات حکومت اسلامی است؛ بخشی از این مختصات مربوط به حل مسائل و مشکلات افراد نیازمند و توجه ویژه به زنان بی سرپرست و بدسرپرست است. نظر به اهمیت نقش زنان در خانواده و جامعه، حمایت از این گروه، ضروری و اجتناب ناپذیر به نظر می رسد، اما سوال اینجاست که مبانی فقهی مسئولیت حکومت در قبال این گروه از زنان چیست؟ پژوهش حاضر با تکیه بر روش توصیفی–تحلیلی و با استناد به ادله ی عام و خاص فقهی، به دنبال کشف شیوه ی مواجهه با این پیامد اجتماعی از حیث انسانی و فقهی است و از سوی دیگر به دنبال شناخت مسیرهایی است که حکوت اسلامی در قبال این پدیده ی اجتماعی پیشنهاد داده است. نگاه حکومت اسلامی از لحاظ فقهی به این زنان حاکی از نوعی باورداشت ویژه از کیفیت نقش آنهاست. این نوشتار در پایان امر با توجه به مبانی مورد نظر، لزوم بازنگری در قوانین جمهوری اسلامی ایران را اثبات و پیشنهاداتی را در این باره مطرح می کند.

Jurisprudential foundations for government responsibility towards derelict and illprotected women

Islamic Republic of Iran as a main constituents and fulfillment operator of Islamic civilization must systematically focus on the Islamic Government’s affairs. A part of these exclusive affairs involves the solutions regarding the problems of those in need; especially Particular attention to derelict and illprotected women. According to the significant role of women in the family and society, it is essential and inevitable to protect them. The question is what are the Jurisprudential foundations for the government’s responsibility towards this group of women? This essay tries to explore humanistic and jurisprudential settlement of this social matter based on analytical – descriptive method and refers to General and special jurisprudential evidences. It is also looking for the Government’s suggestions for this social phenomenon. The jurisprudential approach of Islamic government to these women’s situation represents a kind of special assumption about the quality of their roles. In the end this research provides some evidences to the revision necessity in the Islamic republic of Iran’s law based on intended foundations and it proposes suggestions in this regard.
