بایسته‌ها و ضوابط مفهوم‌شناختی موضوعات در نصوص دینی

مراجعه بدون چارچوب و غیرروش‌مند به تراث عظیم آیات و روایات برای به‌دست‌آوردن گوهر معناشناسی موضوعات شرعی به نتیجه مطلوب نخواهد رسید. برای فهم نصوص شرعی توجه به بایسته‌ها و ضوابطی در فرایند مفهوم‌شناسی ضروری است که در کتب روش‌شناسی اجتهاد کمتر به آن پرداخته شده است. در این نوشتار در ادامه ده بایسته ازپیش‌بیان‌شده که به‌اختصار به آن اشاره می‌شود. شش نکته دیگر برای ترسیم نقشه راه متصدی استنباط در مفهوم‌شناسی موضوعات شرعی شرح داده می‌شود. ده بایسته پیشین عبارت است از: ضرورت مفهوم‌شناسی واژه‌های براینددار؛ رجوع به عرف معیار؛ توجه به فرق تطبیق با تفسیر؛ توجه به بار معنایی هیئات گوناگون؛ بسنده‌کردن به قدر متیقن در موارد مشکوک؛ توجه به اثرپذیری لغوی از اعتقادها و اجتهادها؛ توجه به فرق داعی استعمال با معنا؛ نسبت واژگان؛ واژگان در آینه شریعت؛ کاربرد اعم؛ و تحقیق میدانی. شش بایسته و ضابطه مطرح‌شده در این نوشته عبارت است از: توجه به تفاوت موضوعات شرعی اختراعی و تصرفی؛ موضوع‌شناسی مفاهیم اعتباری شرعی؛ ضرورت فحص جامع عناصر مفهومی در نصوص شرعی؛ فحص قیود موضوع در نصوص شرعی؛ دریافت مناط از عناصر مفهومی در نصوص شرعی؛ و توجه به قرائن در نصوص شرعی. بدیهی است که این شانزده بایسته در کنار هم باید مورد توجه متصدی استنباط قرار گیرد.

referring to the vast heritage of verses and aḥādīth without a framework and without a method to obtain the gem of the semantics of sharia topics will not achieve the desired result. to understand shari’i texts, it is necessary to pay attention to the requirements and criteria in the process of conceptualization, which are less discussed in the methodology books of ijtihad. in this article, ten requirements have been mentioned in advance, which are briefly mentioned. six more points are described for drawing the road map of the inference curator in the conceptualization of the shariah topic. the previous ten requirements are: the necessity of the conceptology of the words, referring to standard custom, attention to the difference between adaptation and interpretation, attention to the semantic load of various formats, satisfying with certainty in doubtful cases, attention to the lexical effectiveness of beliefs and ijtihads, paying attention to the difference between request usage and meaning, the relation between words, the words in the mirror of sharia, general application, and field research. the six requirements and criteria mentioned in this article are: paying attention to the difference between the inventive and possession shariah topics, thematics of shariah itibari concepts, the necessity of a comprehensive examination of conceptual elements in sharia texts, examining the limitations of the topic in sharia texts, receiving standard from conceptual elements in shari’i texts, and paying attention to the evidence in shari’i texts. it is obvious that these sixteen requirements be taken into consideration by the inference operator.
