فقه با انگاره قبول نظامات شرعی و لزوم استنباط آنها و انگاره انکار

وجود نظامات عام و کلی شرعی جدا از احکام بی‌شمار به صورت خُرد و اتمیک در شریعت مطهر اسلام، مورد بحث و گفت‌وگوست. موافقان وجود نظام نیز در یک تقسیم کلان به دو گروه تقسیم می‌شوند: گروهی که استنباط احکام شرعی به صورت اتمیک و جزیره‌ای را برای استنباطِ آنچه در صحن استنباط لازم است، کافی می‌بینند، با این انگاره که متکفل استنباط در همین مرحله از استنباط به نظام‌های شرعی می‌رسد. گروه دیگر حداقل به دو استنباط معتقد است. با این توضیح که متکفل استنباط در مرحله اول به استنباط احکام به صورت فازی و غیر سیستمی (فقه الاحکام) می‌پردازد و در مرحله دوم به استنباط نظام‌ها (فقه النظریات) روی می‌آورد. فرضیه لزوم سه مرحله از استنباط (استنباط اتمیک، استنباط خرده‌نظام‌ها، استنباط کلان‌نظام‌ها یا کلان‌نظام‌واحد) نیز قابل طرح است. انگاره نویسنده اصرار بر قبول نظامات (خرد وکلان) است؛ لکن بر تعدد استنباط و مرحله‌ای‌کردن آن پای نمی‌فشارد، بلکه راه صحیح را استنباط تک‌مرحله‌ای می‌داند؛ لکن در همان مرحله باید همه عناصر به‌حق دخیل در استنباط دیده شود.

one of the discussable topics is the existence of a general religious systems, regardless of the countless rules, in the micro and atomic aspect in the pure shari’a of islam.proponents of the existence of system are divided into two groups in a large scale: a group that considers the atomic inference of religious rules enough to infer what is necessary in the arena of inference, assuming that the performer of inference reaches to canonical systems at this stage of inference. the other group believes in at least two inferences: the performer of inference deduces the rules in a phasic and non-systemic way (jurisprudence of rules) in the first stage, and inferences the systems (jurisprudence of theories) in the second stage.one can propose the hypothesis of the necessity of three stages of inference (atomic inference, subsystem inference, macro system inference, or a single macro system).i insist on accepting systems (micro and macro); however, i do not urge on the multiplicity of inferences and turning it into stages, i rather considers the one-stage inference correct, but at the same stage of inference, all the elements must be rightly involved.
