اطلاق و تقیید حاکمیت سیاسی

حاکمیت عنصری اساسی و بی‌بدیل در مفهوم «دولت-کشور» است و برخی آن را در عرض سرزمین، مردم و حکومت در شکل ‌گیری دولت در مفهوم عام آن شمرده‌اند و برخی برابر حکومت دیده‌اند؛ اما نوعا اطلاق حاکمیت را از مهم‌ترین ویژگی‌های این مفهوم شمرده‌اند. با این حال از نگاه منابع اسلامی و به ویژه منابع فقهی و بنابر تعریفی که از این مفهوم به دست داده می‌شود، باید دید حاکمیت سیاسی آیا امری مطلق و قید‌ناپذیر است؟ در این مقاله پس از اشاره به مفهوم لغوی و بخشی از تعاریف اصطلاحی «حاکمیت»، به بررسی اطلاق و تقیید حاکمیت از نگاه ادله و شواهدی که مورد توجه بوده یا باید به آن توجه شود پرداخته شده و نشان داده شده که دایره قدرت و اختیار حاکمیت هر اندازه گسترده باشد؛ اما مطلق نیست و در همین راستا نسبت تقیید حاکمیت با نظریه ولایت مطلقه نیز نشان داده شده است.

Absoluteness and Determination of Political Sovereignty

Sovereignty is regarded as a fundamental element in the concept of “governmentcountry” so that some persons have generally considered it in parallel with the territory, people and government in the direction of the development of government and some others have regarded it identical with the government. Nonetheless, in view of Islamic sources particularly jurisprudential sources and in accordance with this definition derived out of this concept, it should be investigated whether the political sovereignty is regarded as an inevitable and absolute issue or not. Considering the literal meaning and some idiomatic definitions of “sovereignty”, it has been studied the absoluteness and determination of sovereignty via taking the proofsand the evidences into account and it has been clarified that the domain of authority and resolve of sovereignty is not an absolute issue even regardless of its extensiveness and it has been revealed the proportion of determination of sovereignty and absolute Wilayat in this regard.
