ارزیابی قابلیت اجرای نظریۀ «مسئولیت حمایت» در سیاست خارجی جمهوری اسلامی ایران مبتنی بر مبنای فقهی «تالیف قلوب»

این پژوهش به قابلیت اجرای نظریه مسئولیت حمایت مبتنی بر قاعده فقهی «تالیف قلوب» پرداخته‌است. در پاسخ به این پرسش اصلی که «قلمرو کاربست مبنای تالیف قلوب در نظریه مسئولیت حمایت چه میزان است؟» این فرضیه مطرح شد که «نظریه مسئولیت حمایت، مستنبط از قاعده فقهی تالیف قلوب، می تواند مبنای حقوقی مناسبی برای جامه عمل پوشاندن به موازین حقوق بشری جمهوری اسلامی ایران در سیاست خارجی باشد.» موضوع پژوهش با استفاده از روش توصیفی تحلیلی در سه ساحت تبیین گردید. نخست به امکان شناسایی اصل نظریه مسئولیت حمایت مبتنی بر مبنای تالیف قلوب در دو محورِ «امکان شناسایی نسبت مفهومی با تالیف قلوب» و «امکان شناسایی قابلیت کاربست تالیف قلوب در عصر غیبت» پرداخته شد. سپس با رویکرد تقلیل گرا و تعمیم گرا، که قائل به شمولیت عنوان مولفه قلوبهم نسبت به کفار و مسلمانان است، افراد مشمول مسئولیت حمایت مبتنی بر مبنای تالیف قلوب و قلمرو این مسئولیت مورد شناسایی قرار گرفتند. در ساحت سوم پژوهش کاربست قاعده تالیف قلوب در دکترین مسئولیت حمایت و مراتب اجرای نظریه بحث و بررسی گردید و در ادامه، ضمن تطبیق مراتب مسئولیت حمایت که شامل مسئولیت پیشگیری، مسئولیت واکنش و مسئولیت بازسازی می شود با احکام و عناوین فقهی و شرعی متعدد، مطابقت دو مبنای موضوع تحقیق از حیث راهبردنگاری سلسله مراتبی به اثبات رسید.

Assessing the applicability of the human rights doctrine of responsibility to protect in the foreign policy of the Islamic Republic of Iran based on the jurisprudential basis of Uniting the Hearts

This research has dealt with the ability to implement the theory of protection responsibility based on the jurisprudential rule of Uniting the Hearts. In answer to the main question, What is the scope of application of the basis of the uniting the hearts in the theory of protection responsibility? It was hypothesized that the theory of the responsibility of protection, based on the jurisprudential rule of the uniting the hearts, can be a good legal basis for the implementation of the human rights standards of the Islamic Republic of Iran in foreign policy. The subject of the research was explained in three areas using descriptiveanalytical method. First, it was possible to identify the principle of the theory of responsibility based on the uniting the hearts in the two axes of the possibility of identifying the conceptual relationship with the uniting the hearts and the possibility of identifying the applicability of authorship in the absence. Then, with a reductionist and generalist approach, which considers the inclusion of the title of component of their hearts in relation to infidels and Muslims, individuals subject to the responsibility of protection based on the uniting the hearts and the territory of this responsibility were identified. In the third area of ​​the research, the application of the rule of uniting the hearts in the doctrine of responsibility of protection and implementation of the theory was discussed and then, while applying the levels of responsibility of protection which includes responsibility of prevention, responsibility of reaction and responsibility of reconstruction with jurisprudential rulings and titles.
