تحلیل نظام تایید اعتبارنامه‌ی نمایندگی مجلس شورای اسلامی؛ با تاکید بر الگوی مطلوب

هدف پژوهش حاضر تحلیل نظام تایید اعتبارنامه‌ی نمایندگی مجلس شورای اسلامی است. دراین‌راستا با رویکردی توصیفیتحلیلی، ضمن آسیب‌شناسی و تحلیل نظام موجود و بهره‌گیری از تجربه‌ی سایر کشورها این نتیجه به‌دست آمد که غالب تنش‌های ناشی از عدم‌تایید اعتبارنامه‌ها در مجلس شورای اسلامی، به‌دلیل ناکارآمدی مدل پارلمانی در رسیدگی به اعتبارنامه است؛ برای جبران این نقیصه می‌توان مدل ترکیبی «پارلمانیقضایی» را پیشنهاد کرد. این مدل می‌تواند از دخیل‌شدن ملاحظات سیاسی مغرضانه پیشگیری کرده و موجبات اخذ تصمیم مبتنی‌بر عقلانیت، بی‌طرفی، نگرش حقوقی و قضایی، مصلحتاندیشی، صیانت از حقوق منتخبین و شهروندان و نمایندگی اصیل را فراهم نماید

Analysis of the approval system of the credentials in the Islamic Consultative Assembly with emphasis on the optimal pattern

The purpose of this study is to analyze the system of approving the credentials of the Islamic Consultative Assembly. In this regard, with a descriptiveanalytical approach, with pathology and analysis of the existing system and using the experience of other countries, it was concluded that most of the tensions due to nonapproval of credentials in the Islamic Consultative Assembly are because of the inefficiency of the parliamentary model; to compensate for this shortcoming, a combined parliamentaryjudicial model can be proposed. This model can prevent the involvement of biased political considerations and lead to a decision based on rationality, impartiality, legal and judicial attitude, expediency, protection of the rights of elected and citizens, and genuine representation.
