تحلیل و بررسی دیدگاه‌های فقیهان معاصر دربارۀ قاضی نعمان و آثار او (بررسی موردی نظرات آیت الله سیستانی و آیت الله شبیری زنجانی)

قاضی نعمان (د. 363ق) از تاثیرگذارترین دانشمندان اسماعیلیه در طول تاریخ این مذهب است. از روزگار صفویه که برخی از آثار او، به‌ویژه کتاب حدیثیِ دعائم به‌طور چشم‌گیری به فضای امامیه راه یافت، بحث‌های دنباله‌داری دربارۀ وی و آثار حدیثی‌اش در میان امامیان درگرفته‌‌ که این بحث‌ها به مرور، به‌ویژه در سدۀ اخیر، پختگی بیش‌تری یافته‌است. درمیان برجسته‌ترین فقیهان معاصری که در این‌باره، نظرات شایان‌توجهی ابراز داشته‌اند، باید از آیت‌الله شبیری‌زنجانی و آیت‌الله سیستانی یاد نمود. مقالۀ پیشِ رو، در‌ پی آن است که به واکاوی دیدگاه‌های این دو اندیشمند دربارۀ قاضی نعمان و آثار حدیثی وی بپردازد. در این‌راستا، با مقایسهٔ دیدگاه‌های این دو فقیه با داده‌های موجود در آثار خود قاضی نعمان، منابع دست اول تاریخی و پژوهش‌های اسماعیلیه‌پژوهان معاصر، روشن شد که آیت‌الله سیستانی موشکافانه انگیزۀ تالیف دعائم را این‌گونه تشخیص داده‌اند که فاطمیان با تشکیل حکومت، به ضرورت وجود قانونی برای کشورداری پی‌‌بردند و به همین خاطر، پیگیر تالیف دعائم شدند. هم‌چنین آیت‌الله شبیری زنجانی نیز با ریزبینی، به این مسئله پی‌برده‌اند که قاضی نعمان به منظور روشن‌تر شدنِ مراد حدیث و فتوای خود، گاه در عبارت‌های احادیث دعائم دست‌برده‌است.

analyzing and examining the views of contemporary jurists about al-qāḍī l-nuʿmān and his works(a case study of the viewpoints of ayatollah sīstānī and ayatollah shubeyrī zanjānī )

al qāḍī l nuʿmān al maghribī (d. 363 ah) is one of the most prominent ismāʿīlī scholars. since the safavīd era, when some of his books, especially daʿāʾim, entered the imāmī spaces, there have been constant discussions among scholars about his religion and the validity of his books. in modern times, ayatollah shubeyrī zanjānī and ayatollah sīstānī are two jurists who have made interesting points in dealing with the issues of shiite heritage. this article analyzes the views of these two thinkers about al qāḍī l nuʿmān and his hadith works. in this regard, by comparing the views of these two jurists with the data available in al qāḍī l nuʿmān’s own works, primary historical sources and the researches of contemporary ismaili scholars, it became clear that ayatollah sīstānī has scrutinized the motivation for compiling daʿāʾim as the way that the fātimids realized the necessity of having a law for their government after forming the government and therefore ordered the compilation of daʿāʾim. also, ayatollah shubeyrī zanjānī has also realized this issue with his insight that al qāḍī l nuʿmān in order to clarify the meaning of the hadith and his fatwa, has sometimes changed the words of hadiths in daʿāʾim.
