واکاوی تطبیقی علل و عوامل خوانش متفاوت فقهای مکتب نجف وقم از احادیث ولایت فقیه. با تاکید بر اندیشه امام خمینی و آیت الله خوئی(رحمه الله علیهما)

در واکاوی مقایسه ای از علل و زمینه های خوانش متفاوت فقهای مکتب نجف و قم درباره احادیث ولایت فقیه چهار عامل عمده بدست می آید که عبارت اند از: 1. متن گرایی 2 استظهار عرفی متون 3 اجتهاد انضمامی، 4. ملاک انگاری مقاصد شریعه در مکتب قم. 1. صناعت محوری، 2 . تدقق های عقلی و تکثیر احتمالات 3. تفقه ریاضی وار 4 عدم ملاک انگاری مقاصد الشریعه در مکتب نجف یافته های دهد برخی شیوه های فقاهتی مدرسه آیه الله خویی اختصاص به همان مدرسه داشته و در سیره اجتهادی اساطین فقه شیعه از سابقه چندانی ندارد دیگر این که تحلیل شیوه فقاهتی فقهای دو مکتب حاکی از آن است که فقهای مکتب نجف برخی علل موثر در فهم حدیث را مورد بررسی قرار نمی دهند که سبب اختلاف در فهم واژگان کلیدی ،موضوع از جمله «حاکم»، «الحوادث»، «الحصون»، «ورثه» و ... گردیده و سبب برداشت های مقید و محدود از ولایت فقیه شده است.
