نمونه کاوی انتقادی هفت کتاب دانشگاهی «سیاست جنایی»؛ تاملی در خلا کتاب سنجیِ حقوق

سیاست جنایی، یکی از علوم جنایی نوین است که برآمده از میانکنش سیاستگذاری عمومی و حقوق جنایی، و معطوف به اتخاذ راهبردهای سیستمیِ کنترل بزه و مخاطرات جرم‌زا است. نظر به آن که سیاست‌گذاری جناییِ واقع‌نگر و پایش‌پذیر، بدون تحلیل موانع رَسش این دانش و نمودهای آن در نظام عدالت جنایی ایران ممکن نیست، این مقاله با روش نمونه‌پژوهیِ هدفمند، دَه هفت کتاب ایرانیِ مطرح در سیاست جنایی از بین 50 عنوان کتاب دانشگاهیِ منتشره در این قلمرو از علوم جنایی را صرف‌نظر از التزام به داده‌کاویِ کمّی و تحلیل نرم‌افزاری با روش نمونه-پژوهی هدفمند مبتنی بر الگوی توصیفی-تحلیلی، مورد نقد محتوایی و ساختاری و روش‌گانیِ متعارف در پژوهش‌های نقد کتب حقوقی قرار داده است. طبق این فرضیه که تداوم نشر نوشتارهای نامبتنی بر اصول و ساختار سیاست جنایی به اسم سیاست جنایی، مانع بهره‌برداری از فرصتِ تاریخیِ پدیدآمده از اقبال برنامه درسی جدید کارشناسی ارشد و دکتری حقوق کیفری و جرم‌شناسی (مصوب وزارت عتف- 1401 و 1402) به دانش سیاست جنایی می‌گردد، مقالۀ حاضر نخستین پژوهشِ ایرانی در با تمرکز بر اسلوب کتاب‌سنجیِ «سیاست جنایی»، است که در وضعیت فقدان شاخص‌های مدونِ نقد بروندادهای پژوهشی سیاست جنایی، پیشنهادگرِ ضوابطی برای تالیف کتاب دانشگاهی در سیاست جنایی نیز هست را پیشنهاد می‌کند. پیروی از ساختار تالیف کتب «حقوق کیفری اختصاصی» در تالیف برخی از کتب سیاست جنایی، فقدان ساختار درختواره‌ایِ متناسب با ماهیت سیستمیِ دانش و کنش سیاست جنایی، خلط مفهومی اصطلاحات کیفری و جزایی و جنایی، غفلت از خوشه‌شدگیِ سیاست جنایی از سیاست عمومی، و تقلیل تحلیلِ بایسته در نوشتار مطلوب است جنایی به حد تحلیل مواد قوانین کیفری، مهمترین نقدهای وارد به کتاب های مورد بررسی این مقاله است.

a critical case sampling ofseven textbooks on criminal policy; a research on the void of legal books bibliometric

criminal policy is a new criminal science that emerges from the interaction of public policy and criminal law, and is focused on adopting systemic strategies to control crime and deviant risks. given that realistic and monitorable criminal policymaking is not possible without analyzing the obstacles to the access of this knowledge and its manifestations in the iranian criminal justice system, this article, using a targeted case study method, has subjected ten seven prominent iranian books on criminal policy, out of 50 academic academic books published in this field of criminal science, to content and structural criticism, and conventional methodologies in legal book criticism research, regardless of their commitment to quantitative data mining and software analysis with a purposeful sampling method based on a descriptive-analytical model. according to the hypothesis that the continued publication of writings that are inconsistent with the principles and structure of criminal policy in the name of criminal policy prevents the exploitation of the historical opportunity created by the positive approach of the new curriculum for the master’s and doctoral degrees in criminal law and criminology (approved by the iranian ministry of science in 2022 and 2023) to the knowledge of criminal policy, the present article focuses on the bibliometric method of criminal policy is the first iranian research on bibliometrics of criminal policy academic books, which, in the absence of codified indicators for criminological research outputs suggests criteria for writing a academic books on criminal policy. following the structure of writing books on special criminal law in the writing of some books on criminal policy, the lack of a tree-like structure appropriate to the systemic nature of the knowledge and action of criminal policy, the conceptual confusion of the terms criminal and penal, neglecting the clustering of criminal policy from public policy are the most important criticisms of the academic books reviewed in this article.
