پژوهش در علوم جنایی: با رویکردی انتقادی و با استناد به برنامه های درسیِ رشتۀ حقوق جنایی و جرم شناسی

این مقاله با نمایاندنِ اهمیت پژوهش در پهنۀ علوم جنایی، وضعیتِ این علوم را در سامانۀ آموزش عالیِ ایران (با تمرکز بر رشتۀ حقوق، و به‌ویژه گرایش تحصیلات تکمیلیِ حقوق جنایی و جرم‌شناسی)، با رویکردی انتقادی بررسی می‌کند.مقاله با معرفی گونه‌های پژوهش نظری و عملی در علوم جنایی، نشان می‌دهد که شکل نظریِ پژوهش در این علوم به طور برجسته‌ای نسبت به گونۀ عملیِ پژوهش، در سامانۀ آموزش عالیِ ایران پررنگ‌تر و رایج‌تر است. نویسنده استدلال می‌کند که با وجود سهم علوم جناییِ حقوقی در پژوهش‌های نظری، این گونه پژوهش‌ها در علوم جناییِ تجربی نیز غالب بوده اند. به منظور اثبات این فرضیه که سهم پژوهش‌های نظری نسبت به گونۀ عملیِ آن‌ها در علوم جنایی در ایران بیش‌تر بوده است، نویسنده با بهره‌گیری از روش توصیفی-تحلیلی با ابزار کتاب‌خانه‌ای، به فراخور از از داده‌های استنادی با آوردنِ نمونه‌هایی از نوشتگان و آثار علوم جنایی در ایران، همراه با برخی گزارش‌ها، آمارها و سندها، نیز بهره برده است.نویسنده با معرفی مهم‌ترین چالش‌های پژوهش در علوم جنایی در ایران (شامل نبودِ معیار و ضابطۀ مشخص و مدوّن در روش‌شناسیِ پژوهش در علوم جنایی، افزایش کمّی و کاهش کیفیِ پژوهش‌‌های علوم جنایی و بازتاب آن‌ها در سطح سیاست‌گذاری، و اخلاق حرفه‌ایِ پژوهش در پهنه علومِ جنایی)، راهکارهایی برای برون‌رفت از آن‌ها پیشنهاد داده است.

research in criminal sciences; with an critical approach to and with a special reference to the graduate course of criminal law and criminology

abstractbased on a critical attitude, and with an emphasis on the importance of research in the sphere of criminal sciences, this article explores the situation of these disciplines, focusing upon the postgraduate education of criminal law and criminology within the high educational system of iran. by introducing theoretical and applied methods of research in criminal sciences, the article demonstrates that theoretical research method is more prevalent than applied research method in criminal sciences. the author argues that theoretical research method has been predominant not only in the legal areas of these sciences (i.e. the branches of criminal law) but also in their empirical fields of study (e.g. criminology and penology). for the purpose of a proof for this hypothesis, the author enjoys the descriptive-analytical method by documentary research including literature, reports, and statistics. the author discusses about the most significant challenges of research in criminal sciences including the lack of a definite criteria of research methodology in these areas, quantitative growth and qualitative decline of research in these fields and its influence on the policy-making, and finally, the ethics of research in criminal sciences. consequently, the author provides with some suggestions to overcome the challenges.
