آثار تغییر در مفهوم عدالت در حقوق (تحلیل محتوای قوانین مرتبط با روابط کار ایران)

مقدمه: در تحقیق حاضر به بررسی آثار گذار از مفهوم متافیزیکی عدالت به مفهوم اجتماعی آن در حقوق پرداخته شده است. در گذار از قرن 19 به 20 انتقاداتی به مبنا قرار گرفتن عدالت متافیزیکی در حقوق وارد شد. در نتیجه این انتقادات حقوق برمبنای عدالت اجتماعی بنا نهاده شد. این تحول موجب تغییراتی اساسی در حقوق شد. با توجه به اینکه حقوق کار، بسیار متاثر از این تغییرات بوده، در این تحقیق به آثار گذار از مفهوم متافیزیکی عدالت به مفهوم اجتماعی آن در ابتدا و به صورت کلی و سپس در محتوای قوانین مرتبط با روابط کار ایران پرداخته شد.روش: روش مورد استفاده در این پژوهش، تحلیل محتوا است که روی قوانین مرتبط با روابط کار ایران از سال 1307 تا 1369، در پنج بعد اصلی عدالت اجتماعی و پنج بعد اصلی عدالت متافیزیکی انجام شده است. واحد تحلیل تحقیق، موضوع، در نظر گرفته شده است. واحدهای موضوعی برحسب تطابق و تناظرشان با تعریف ساختاری خاص محتوا، مشخص شدند. تمایز آنها از هم برمبنای مفهومی و برحسب برخورداری از ویژگیهای ساختاری مطلوب در تقابل با بخش باقیمانده مطالب بی ربط بود.یافته ها: از سال 1307 تا 1369 میزان بکارگیری مفاهیم عدالت اجتماعی افزایش یافته است. در نتیجه این افزایش و کاهش بکارگیری مفاهیم عدالت متافیزیکی نسبت به عدالت اجتماعی، تغییراتی در قوانین مرتبط به روابط کار ایران رخ داده است. به طوریکه از سال 1307 تا 1369 میزان توجه به عدالت توزیعی، کارکردهای اجتماعی قوانین، نظم اجتماعی، حقوق شهروندی و انعطاف قوانین افزایش یافته است. بحث: از سال 1325 به بعد قوانین به جای منفعت فردی بر مبنای حقوق شهروندی بنا نهاده شده است و از انعطاف بیشتری برخوردارند و در مجموع به سود کارگر تغییر کرده اند و جنبه های حمایتی آنها افزایش یافته است.

The Implication The Metaphysical Concept of Justice to Its Social in Law (case study: Labor Law Iranian)

Intruduction : This research investigates the implications of the transition from the metaphysical concept of justice to its social concept in law. Throughout 19th century and 20th century, the metaphysical justice as a basis for law was criticized. As a result, social justice was emphasized as a basis for law. This transformation brought about some fundamental changes in law. Since labor law was deeply affected by these changes, the implications of the transition from the metaphysical concept of justice to its social concept in general was investigated and the transitionrsquo s practical consequences for the Iranian laws on employment and labor relations were examined.Method: This research is done through content analysis. There is no sling and the research was done through census technique and all the statistical population is examined. The analysis unit is subject ndash single statement about something. The content of the Iranian laws related to labor relations from 1928 to 1990 was examined focusing on the five main aspects of social justice and five main aspects of metaphysical justice. The subject units are specified based on their correspondence and compatibility with the special structural definition of content. Their distinction is conceptual based on having desirable structural characteristics in comparison to the irrelevant remainder materials.Findings: From 1928 to 1990, the social justice conceptsrsquo usage has increased. Because of this and a decrease in metaphysical justice concepts in proportion to social justice, the following changes have occurred in the Iranian laws regarding labor relations: from 1928 to 1990, there is an increase in taking into consideration distributional justice, social functions of law, social order, civil rights and flexibility of law.Discussion: From 1946 on, the laws are based on civil rights instead of individual interests. They are more flexible and are changed toward the workerrsquo s interests and their supportive aspects have increased.
