رابطۀ همگنانۀ اخلاق و فقه در آیات امربهمعروف و نهی‌ازمنکر (با محوریت تاثیرگذاری و حاکمیت اخلاق)

علم فقه و علم اخلاق، دو دانش اصیل اسلامی اند که تاثیر متقابلی بر یکدیگر دارند و مکمل و متعاضد هم به حساب می آیند؛ چراکه هدف مشترکی را که همان امتثال اوامر الهی و تقرب به اوست، دنبال می‌کنند. امربه‌معروف و نهی‌ازمنکر، از جمله واجبات فقهی اند که اخلاق، جلوۀ ویژه ای در آن‌ها دارد. در واقع، این واجبات، بدون پشتوانۀ اخلاق عملاً تاثیر مفید و ماندگاری بر فرد و جامعه ندارند. در آیات قرآن کریم هم ضمن بیان ابعاد مختلف وجوب امر‌به‌معروف و نهی‌ازمنکر، بر حاکمیّت روح اخلاق بر آن ها تاکید شده است. ازاین‌رو، پژوهش حاضر با استفاده از روش توصیفیتحلیلی، درصدد بیان ارتباط همگنانه بین اخلاق و فقه در آیات امربه‌معروف و نهی‌ازمنکر است. در تبیین این ارتباط، بر محوریت تاثیرگذاری و حاکمیت اخلاق بر فقه تاکید می‌شود؛ همان‌گونه که دیگر آموزه های فقهی اسلامی نیز از چنین پیشینه و پشتوانه ای برخوردارند.

The homogeneous relationship between ethics and jurisprudence in the verses of enjoining the good and forbidding the evil )with the focus on influence and the rule of ethics(

The science of jurisprudence and the science of ethics are two original Islamic sciences that have a reciprocal effect on each other and are considered complementary; because they have a common purpose, which is to obey the divine commands and be close to Him. Enjoining the good and forbidding the evil are among the jurisprudential obligations in which morality has a special effect, without morality they do not have a useful and lasting effect on individuals and society. In the verses of the Holy Quran, while stating the various dimensions of the obligation of enjoining the good and forbidding the evil, it fully shows the dominance of the spirit of morality over them. Therefore, the present study, using a descriptiveanalytical method, seeks to express the complementary relationship between ethics and jurisprudence in the verses of enjoining the good and forbidding the evil. Emphasizing this paradigm, in which the focus is on the influence and rule of ethics on jurisprudence, as well as other teachings of Islamic jurisprudence have such a background and support.
