درآمدی بر مبانی رابطۀ حقوق و اخلاق در سنجۀ منطق ‌فازی: تعامل یا تعارض

تاثیرپذیری قانون‌گذار از اخلاق و شریعت، برای رسیدن به اصل تناسب در قوانین، انکارناپذیر است. گاه دستورهای اخلاقی و گاه دستورهای حقوقی، نظم اجتماعی را ایجاد می‌کنند. بعضی بر این باورند که اخلاق و حقوق با یکدیگر در تعارض‌اند و بعضی این دو را مکمل و متعادل‌گر هم می‌دانند. هدف از این پژوهش، بررسی رابطۀ اخلاق و حقوق بر اساس تفکر فازی است. در حقیقت، بر اساس نظریۀ فازی‌سازی، نوعی نگرش جدید دربارۀ رابطۀ حقوق و اخلاق در نگارش قوانین و روابط حقوقی به وجود می‌آید. لذا بر مبنای منطق و تفکر ‌فازی، کنجکاوی و دقّت شناختن متغیرهای این مسئله و درک چرایی روابط حقوق و اخلاق موردنظر است و بر این اساس، زمینه‌یابی رابطه میان حقوق و اخلاق با تفکر فازی را مى‌توان به‌طور موسع در عرف عام یافت. نتیجه اینکه یکی از نظریه‌های مطرح‌شده در این پژوهش این است که برای تحقق بیشتر عدالت باید از مبانی و اصول اساسی اخلاقی تفکر فازی در حقوق و قانون‌گذاری در مباحث کیفری و مدنی و بازرگانی و غیره استفاده شود.

Introduction to the Basics of the Relationship between Law and Ethics in Fuzzy Logic Measurement: Interaction or Conflict

The influence of the legislator on ethics and sharia to achieve the principle of proportionality in the laws is undeniable. Sometimes moral precepts and sometimes legal precepts create social order. Some believe that morality and law are in conflict with each other, and some see the two as complementary and balanced. The purpose of this study is to investigate the effect and relationship between ethics and law based on fuzzy thinking. In fact, based on fuzzy theory, we are looking for a new approach to the relationship between law and ethics in the writing of laws and legal relations. Therefore, based on logic and fuzzy thinking, curiosity and accuracy seek to know the variables of this issue and understand why the relationship between law and ethics is concerned. Therefore, the context of the relationship between law and ethics with a fuzzy thinking can be found widely in common practice. The conclusion is that one of the researcher’s mental theories is to use the basic principles and principles of fuzzy ethics in law and legislation in criminal, civil, commercial and other issues for more justice.
