   تبیین شروط و الزامات حقوقی محدودکننده انتقال فناوری دارویی در توافقات فراتریپس

چکیده    زمینه و هدف: توافقات فراتریپس با هدف ایجاد تعادل در رابطه میان سازندگان داروی اصلی و دریافت‌کنندگان فناوری دارویی، حاوی شروط متعددی در فصل مربوط به حقوق مالکیت فکری و حقوق اختراعات دارویی هستند. هدف از نگارش این پژوهش، معرفی و توصیف این شروط و سپس تحلیل آثار ناشی از تدوین و اجرای این مقررات، بر انتقال فناوری دارویی است. روش: این پژوهش یک مطالعه مروری است. گردآوری اطلاعات بر مبنای روش کتابخانه‌ای بوده و از منابع و مقالات معتبر انگلیسی و فارسی در پایگاه‌های heinonline، south centre، noormags و قراردادهای امضاشده در حوزه حقوق مالکیت فکری و اختراعات دارویی در وبگاه رسمی سازمان نمایندگی تجاری آمریکا (ustr) و همچنین قوانین معتبر ایالات متحده آمریکا در وبگاه سازمان غذا و داروی آمریکا(fda) استفاده شده است. ملاحظات اخلاقی: در انجام پژوهش و نگارش مقاله، به اصول اخلاقی، اصالت متون و امانتداری توجه شده است. یافته‌ها: در این پژوهش شروط محدودکننده انتقال فناوری دارویی در قراردادهای فراتریپس بررسی شد و با توجه به میزان گسترش این مقررات در توافقات فراتریپس، به دو دسته شروط متداول (شرط انحصار داده، شرط تمدید اعتبار حق اختراع، محدودیت در واردات موازی، حمایت از استفاده نوین از داروهای قدیمی و محدودیت لیسانس اجباری) و شروط نوین (شرط پیوند یا به‌هم‌پیوستگی حق اختراع، حمایت از داروهای بیولوژیک و مهلت ارفاقی) تقسیم گردید. نتیجه‌گیری: قراردادهای فراتریپس و شروطی که با هدف حمایت از حقوق مالکیت فکری و اختراعات دارویی خلق شده‌اند، خود موانع قابل ‌توجهی را در مسیر انتقال فناوری دارویی به کشورهای در حال توسعه و دسترسی به داروهای ژنریک ایجاد می‌کنند. این امر می‌تواند به اهداف حقوق بشری و حقوق پزشکی، از جمله حق دسترسی عموم به دارو و سلامت عمومی، آسیب برساند. با این حال از میزان استقبال از این توافقات کم نشده و شروط حمایتی جدیدتر و سخت‌گیرانه‌تری نیز تدوین شده و کشورهای در حال توسعه به علت فشارهای متعدد اقتصادی، تجاری و سیاسی به این توافقات ورود پیدا می‌کنند.

   analysis of restrictive clauses on pharmaceutical technology transfer in trips-plus agreements

Abstract    background and aim: trips-plus agreements establish various terms governing the relationships between originators and recipients of pharmaceutical technology, particularly in the realm of intellectual property rights and pharmaceutical patents. this study aims to introduce and describe these terms, followed by an analysis of their effects on the transfer of pharmaceutical technology.methods: this research employs a review methodology, gathering information through a library-based approach utilizing credible english and persian resources. articles from the heinonline, southcentre and noormags databases were consulted, along with agreements related to intellectual property rights and pharmaceutical patents available on the official website of the office of the united states trade representative (ustr). additionally, relevant regulations from the united states food and drug administration (fda) were referenced.ethical considerations: throughout the research and writing process, ethical principles were upheld, ensuring the originality of the text and the reliability of the sources used.results: this study analyzes the terms that restrict the transfer of pharmaceutical technology in trips-plus agreements. given the extensive nature of these regulations, they are categorized into two groups: common terms (data exclusivity, patent term extension, restrictions on parallel imports, protection of new uses of known drugs and limitations on compulsory licensing) and new terms (patent linkage, protection of biologics and grace periods).conclusion: trips-plus agreements and their associated regulations for intellectual property rights and pharmaceutical patents create significant barriers to the transfer of pharmaceutical technology to developing countries and restrict access to generic drugs. this situation poses risks to human rights and medical rights, particularly the public’s right to access medicine and ensure public health. despite these challenges, the acceptance of such agreements remains high, with newer and stricter protective regulations being developed. developing countries often enter into these agreements due to various economic, commercial and political pressures.
