چالش‌های اخلاقی حق بر سلامت کودکان در زیست‌بومِ متاورس

زمینه و هدف: «متاورس» جهانی مجازی و سه‌بعدی که کاربران قادرند در آن از طریق آواتارها با یکدیگر ارتباط برقرار کنند. در واقع این تعاملاتِ بشری است که با گذرِ زمان و پیشرفت فناوری‌های دیجیتال شکلِ تازه‌ای پیدا کرده و انسان را با مسائل اخلاقی و حقوقی بسیاری که بر افراد در شرایطِ متفاوت موثر است، مواجه کرده است. فارغ از مسائل حقوقی گوناگون مرتبط با متاورس، یکی از مسائل مهم در این زمینه حمایت‌ اخلاقی از حق بر سلامت کودکان و کرامتِ انسانی آن‌ها در زیست‌بوم متاورس است. هدف از مقاله حاضر پاسخ به این پرسش اصلی است که چالش‌های اخلاقی تحقق حق بر سلامتِ زیستی کودکان در زیست‌بوم متاورس چیست؟ روش: در این پژوهش تحلیلی اسناد و مقالات سال 2015 تا 2023 با استفاده از پایگاه‌های web of science، scopus، science directs، noormags، civilica و بر اساس واژگان کلیدی پژوهش metaverse، children’s right’s، bioethics، rights to health، artificial intelligence، متاورس، حقوق کودکان، حق بر سلامت در محیط دیجیتال بازیابی گردید. از میان 50 مقاله یافت‌شده، تعداد 41 مقاله مرتبط، مرور گردید. پس از استخراج و تحلیل چالش‌های اخلاقی حمایت از حقوق کودکان در متاورس، راهکارهای حقوقی برای ان ارائه گردید. ملاحظات اخلاقی: صداقت و امانتداری در گزارش متون، استناددهی به منابع و پرهیز از هرگونه سوءگیری رعایت گردیده است. یافته‌ها: اخلاقِ زیستی یکی از گستره‌های دامنه‌دار در مسائلِ اخلاقی، اجتماعی و سیاسی است که انواع علوم زیستی در حوزه‌های مختلف را به‌ وجود آورده است و به‌ طور چشم‌گیری در کیفیت زندگی انسان‌ها به خصوص کودکان موثر است. نتایج حاصل از دسته‌بندی نتایج مقالات مورد مطالعه به 4 مفهوم اصلی دسته‌بندی و توضیح داده می‌شوند که شامل 1 پیامدها و چالش‌های حقوقی در زیست‌بوم متاورس؛ 2 بسترها و ابزارهای مورد نیاز جهت حمایت از حق بر سلامت کودکان در متاورس؛ 3 ایجاد شبکه پیچیده از مجموعه داده‌ها از طریق بلاکچین؛ 4 استفاده از هوش مصنوعی در زمینه‌های مرتبط با حریم خصوصی می‌باشد. نتیجه‌گیری: کودکان می‌توانند از تجربه نسبتاً واقعی و کاربردی که متاورس ارائه می‌دهد، بهره ببرند و درک خود را از جهان بهبود بخشند، اما خطراتی که کودکان در این زیست‌بوم با آن مواجه می شوند، بسیار مهم است و مقابله با آن‌ها نیاز به راه‌ حل‌های هوشمندانه دارد. حقوق بنیادین کودکان در محیط دیجیتال دارای مصادیق متعددی است که مهم‌ترین آن‌ها عبارتند از: حق بر آموزش، حق بر امنیت، حق بر بازی، حق بر حریم خصوصی و حق برخورداری از حمایت‌های اجتماعی بعد از بزه‌دیدگی است، اما در زیست‌بوم متاورس کودکان با نقض شدید حق بر امنیت خود و حق بر حریم شخصی خودشان مواجه هستند که در همین راستا اهتمام قانونگذار در قبال مساله حمایت‌های موثر از کودکان در محیط‌های مجازی به ویژه متاورس باید به قانونگذاری خاص در این زمینه منجر گردد.

background and aim: the metaverse is a virtual, three-dimensional world where users interact throughavatars. this new form of human interaction, shaped by advancements in digital technology, presents numerousethical and legal challenges affecting individuals in various circumstances. beyond the diverse legal issuesassociated with the metaverse, it raises critical concerns about the ethical protection of children's right to healthand human dignity within this digital ecosystem. this study's primary objective is to address the centralquestion: what are the ethical challenges to realizing children’s right to biological health in the metaverseecosystem?methods: this analytical study reviewed 41 relevant articles (from an initial pool of 50 identified using web ofscience, scopus, sciencedirect, noormags and civilica databases) published between 2015 and 2023.keywords included: metaverse, children’s rights, bioethics, right to health, artificial intelligenceand their persian equivalents. the ethical challenges regarding the protection of children’s rights in themetaverse were extracted and analyzed, followed by the proposal of legal solutions.ethical considerations: the principles of honesty and integrity were observed in reporting the literature,citing sources and avoiding bias.results: bioethics encompasses a wide range of ethical, social and political issues significantly influencing lifesciences and the quality of life, particularly for children. the reviewed articles yielded four main themes:1. legal implications and challenges within the metaverse ecosystem; 2. frameworks and tools required tosupport children’s right to health in the metaverse; 3. the creation of complex data networks throughblockchain technology; 4. the use of artificial intelligence in areas related to privacy.conclusion: while the metaverse offers potentially immersive and beneficial experiences for children,enhancing their understanding of the world, the risks they face are significant and require proactive solutions.fundamental children’s rights-including the right to education, safety, play, privacy and access to socialsupport are particularly vulnerable to violation in the metaverse, especially regarding security and privacy. thisunderscores the need for legislators to develop specific legal frameworks to protect children in virtualenvironments, particularly within the metaverse.
