تاثیر بازنمایی رسانه‌ای جرم بر دادرسی منصفانه با تاکید بر پرونده آتنا اصلانی

یکی از مهم‌ترین کارکردهای جرم‌ شناسی فرهنگی تمرکز بر بازنمایی رسانه‌ای جرم و جرم‌انگاری رسانه‌ای است. امّا بازنمایی رسانه‌‎ای همان ‌گونه که بر وقوع جرم تاثیر‌گذار است و از طریق رمزگذاری پیام‌های خاص در انواع رسانه‌ها سعی در پیشبرد اهداف کارفرمایان اخلاقی در جامعه جهت بهره‌برداری از هراس اخلاقی شهروندان برای جرم‌انگاری دارد به همان میزان و با همان روش توان تحت‌تاثیر قرار‌دادن جریان دادرسی منصفانه را دارد؛ به‌گونه‌ای که بعد از ارتکاب بعضی جرایم در راستای اقناع کارفرمایان اخلاقی جامعه قبل از اتمام رسیدگی در مراجع قضایی اقدام به محکومیت متهمان می‌کنند. شدت و میزان تحمیل این بازنمایی در روند دادرسی کیفری بستگی به میزان گرایش و وابستگی این رسانه‌ها به کارفرمایان اخلاقی در جامعه دارد. در این مقاله از طریق تحلیل محتوای پرونده قتل آتنا اصلانی در رسانه اعم از نوشتاری و دیداری سعی شده است که تاثیر بازنمایی رسانه‌ای بر اصول دادرسی منصفانه مورد بررسی قرار بگیرد. نتیجه حاصل از این پژوهش این است که بازنمایی رسانه‌ای آن به‌دلیل تاثیرپذیری از پوپولیسم کیفری و از طرفی نقش صاحبان قدرت قبل از صدور حکم قطعی، محکومیت رسانه‌ای متهم پرونده در قالب نمادسازی‌های رسانه‌ای رخ‌داده و لذا دادرسی در این پرونده به‌دلیل خدشه به اصولی چون برائت و رسیدگی در مدت معقول نقض شده است.

one of the most important functions of cultural criminology is to focus on media representation of crime and media criminalization. however, media representation, just as it affects the occurrence of crime and, through encoding specific messages in various media, tries to advance the goals of moral employers in society to exploit citizens’ moral fear of criminalization, has the same ability to influence the fair trial process to the same extent and in the same way; in such a way that after committing some crimes, in order to convince the moral employers of society, they try to convict the defendants before the completion of the proceedings in the judicial authorities. the intensity and extent of imposition of this representation in the criminal trial process depends on the degree of tendency and dependence of these media to moral employers in society. in this article, through content analysis of the case of the murder of atena aslani in the media, both written and visual, an attempt has been made to examine the impact of media representation on the principles of fair trial. the result of this research is that its media representation, due to being influenced by criminal populism and on the other hand the role of those in power before issuing a final verdict, the media conviction of the accused in the case occurred in the form of media symbolism, and therefore the trial in this case was violated due to the violation of principles such as innocence and trial within a reasonable time.
