جرم ‌انگاری جرایم علیه اخلاق و عفت عمومی در فضای سایبری، علاوه‌ بر آنکه نقاط قوت امر را روشن می‌سازد، خلا‌ها و نقاط ضعف را نیز، جهت وضع عناوین مجرمانه، پیش‌ روی قانون‌گذار قرار می‌دهد؛ لکن ایجاد محدودیت‌های رفتاری از طریق جرم‌انگاری، امری مغایر با اصل اولیه آزادی و اباحه اعمال است که باید تنها به موارد مهم و حیاتی بسنده و از تحدید دامنه فعالیت‌های ارادی افراد، خودداری کرد. این مقاله با روش توصیفی ‌‌ تحلیلی، ضمن بررسی ارتکاب جرایم علیه اخلاق و عفت عمومی به طور اخص هرزه‌نگاری و قوادی در فضای سایبری، به بررسی روش‌های پیشگیری اجتماعی و وضعی برای مقابله با جرایم سایبری در این محیط می‌پردازد. طبق نتایج از بین روش‌های پیشگیری اجتماعی علیه جرایم سایبری به تدابیر اجتماعی رشدمدار با زیرمجموعه‌های پیشگیری خانواده‌مدار و پیشگیری آموزشی‌‌ سایبری و از میان تدابیر جامعه‌‌مدار به اطلاع‌رسانی، مشارکت و اجماع‌گری، ارتقای پاسخگویی و فرهنگ‌سازی اشاره شد. همچنین از میان روش‌های پیشگیری در فضای مجازی به تدابیر پیشگیری وضعی با زیرمجموعه‌های تدابیر محدودکننده، تدابیر نظارتی، ‌صدور مجوز و ابزارهای ناشناس‌کننده و رمزگذاری اشاره شد که به کمک این تدابیر امکان مقابله با انحرافات رفتاری فضای سایبر تا حد زیادی میسر خواهد بود.

criminalizing crimes against public ethic and decency in cyberspace, in addition to highlighting the strengths of the case, also puts gaps and weaknesses before the legislature to establish criminal titles, but creating behavioral restrictions through criminalization is contrary to the basic principle. it is freedom and obscenity of actions that should be limited to the most important and vital issues and should not limit the scope of voluntary activities of individuals.this article, with a descriptive-analytical method, examines the commission of crimes against public ethic and decency, especially pornography and prostitution in cyberspace, and examines social prevention methods and the situation for combating cybercrime in this environment. according to the results, among the social prevention methods against cybercrime, situational-oriented social measures with sub-categories of family-oriented prevention and educational-cyber prevention, and among society-based measures, information, participation and consensus, accountability promotion and culture building were mentioned. also, among the prevention methods in cyberspace, situational prevention measures with a subset of restrictive measures, surveillance measures, licensing and identification and encryption tools were mentioned, which with the help of these measures, it will be possible to deal with cyber behavioral deviations to a large extent.
