پیوندهای حقوق عمومی و حقوق مالکیت ادبی و هنری: درآمدی بر مبانی نظری

حقوق مجموعه ای از قوانین و مقررات حاکم بر روابط اجتماعی انسان هاست که کار ویژه اصلی آن ایجاد نظم و عدل در این روابط است. بدیهی است که در این راستا صرف وجود قواعد و مقررات بدون ایجاد یک ساختار پویا و هدفمند که امکان اجرای آن قواعد را فراهم آورد و حقوق را به عرصه عمل وارد نماید، کافی نخواهد بود.به همین جهت قانون گذاران مدبر همواره سعی دارند که در خلال قوانین تصویبی، ضمانت اجراهای مناسب و کارآمدی را نیز پیش بینی نمایند تا از نقض قوانین جلوگیری و یا ناقضین آن را مجازات نمایند. اعمال این ضمانت اجراها از طریق اقتدار عمومی صورت می پذیرد.از طرف دیگر مقوله های نظم عمومی و منفعت عمومی به عنوان اساسی ترین مفاهیم حقوق عمومی، بر حمایت از حقوق شهروندان اثر گذارند. همچنین قانون اساسی الهام بخش قوانین مربوط به حقوق مالکیت ادبی و هنری، است؛ سندی که مهم ترین موضوع مورد بررسی حقوق عمومی می باشد.بر این اساس در مقاله حاضر سعی می شود پیوندهای حقوق مالکیت ادبی و هنری با حقوق عمومی در چارچوب موارد پیش گفته، تبیین گردد.

Relationship between Public law and Literary and Artistic Property Law: An Introduction to the Theoretical Foundations

Law is a set of rules and regulations governing the human social relations that its main task is establishing order and justice in these relations.Obviously, in this regard, the mere existence of rules without creating a dynamic and purposeful structure that provides the possibility of implementing rules will not be enough. So resourceful legislators always try to predict appropriate and effective sanctions to prevent infringement of laws or to punish violators. These sanctions are imposed by the public authority.On the other hand the public order and public interest as the most fundamental concepts of public law affect protecting the right of citizens. Also literary and artistic property laws is inspired by constitution; that is the main subject of public law.In this paper the links between literary and artistic property law and public law in the context of the above are explained.
