نقش سازمان جهانی مالکیت فکری در ظرفیت‌سازی و ارتقای جایگاه سازمان‌های مدیریت جمعی در نظام‌های حقوقی ملی

مدیریت جمعی در حوزه کپی رایت و حقوق مرتبط با ایجاد پلی میان حقوق و منافع صاحبان حق و مصرف کنندگان، نقش بسیار مهمی در ارتقای حمایت از مالکیت فکری و آثار اقتصادی ناشی از آن در جامعه، به ویژه در عصر دیجیتال، ایفا می کند. سازمان جهانی مالکیت فکری که امروزه یکی از اهداف خود را حمایت از مالکیت فکری در خدمت به توسعه اقتصادی کشورها اعلام می کند، با علم به نقش سازمان های مدیریت جمعی در حوزه کپی رایت و حقوق مرتبط، از حدود دو دهه پیش با ایجاد اداره ای به نام اداره مدیریت جمعی کپی رایت تحت نظر برنامه همکاری های توسعه ای این سازمان، به ایفای نقش در جهت ارتقای جایگاه سازمان های مدیریت جمعی در کشورهای عضو، به ویژه کشورهای در حال توسعه پرداخته است. وایپو این نقش را از طریق تشویق تاسیس و ساماندهی این دسته از سازمان ها، ارائه مشورت های حقوقی، ظرفیت سازی، نهادسازی و تربیت نیروی انسانی و ارائه کمک های فنی و اداری ایفا می کند. در این مقاله برآنیم تا با بررسی اهمیت مدیریت جمعی کپی رایت و حقوق مرتبط به ویژه در دنیای دیجیتال جدید، دلایل و سابقه توجه سازمان جهانی مالکیت فکری به این موضوع را مرور کنیم و سپس اقدامات عملی سازمان جهانی مالکیت فکری در راستای ارتقای جایگاه این سازمان ها را مورد بحث قرار دهیم.

WIPO’s Role in Capacity Building and Promotion of Collective Management Organizations in Domestic Legal Systems

Collective management in the field of copyright and related rights which bridge the gap between the rights and interests of the right holders and users, plays an important role in the promotion of intellectual property rights and its economic implications in the society, in particular on digital age. World Intellectual Property Organization (WIPO) which follows the goal of protection of IP rights to serve the economic development of the member states by noting the importance of role played by collective management organizations in copyright and related rights, has helped enhancement of collective management organizations in member states, especially in developing world, through establishment of an office named Copyright Collective Management Division (CCMD). This functions under the auspice of Development Cooperation Program from two decades ago. WIPO implements this mission by encouragement of establishing such organization, making necessary arrangement among them, providing legal advices, capacity building, institution building and training human recourses as well as offering technical and administrative assistance. This article tries to examine the collective management of copyright and related rights particularly in new digital era, and further review the background and reasons of the WIPO’s attention to this subject. The article also studies the measures taken by WIPO which are aimed at the promotion of the status of this Organization.
