حمایت از آثار هنر معاصر در رویه قضایی آمریکا

آثار هنر معاصر بخشی از هنر است که به علت ویژگی های ذاتی خود نمی تواند شرایط و ضوابط تعریف شده در هنر سنتی را دارا باشد. در این بخش از هنر اصالت، تفکیک ایده از بیان و تثبیت به شکلی که در حقوق کپی رایت به رسمیت شناخته شده، وجود ندارد. همین امر موجب گردیده مقررات ملی و بین المللی در وضعیت کنونی خود نتوانند از این آثار حمایت نمایند.از آنجایی که این ادعا مطرح است که مفهوم اصالت در معنی سنتی آن در خصوص آثار هنر معاصر تحقق نمی یابد این آثار در بخش وسیعی از مصادیق خود حقوق آثار پیش از خود را نقض می کنند و همین امر موجب طرح دعاوی متعددی علیه صاحبان این آثار گردیده است.رویه قضایی آمریکا در مواردی با استناد به دکترین استفاده منصفانه با ارجاع به بخش 107 قانون کپی رایت 1976 این کشور از آثار هنر معاصر حمایت نموده است.این مقاله کوشش دارد ضمن تبیین تفاوت حقوقی میان خصوصیات آثار هنر معاصر با شرایط تعیین شده در مقررات بین المللی برای حمایت از اثر، به این سوال پاسخ دهد که رویه قضایی آمریکا چگونه و تحت چه شرایطی با بهره گیری از دکترین استفاده منصفانه از آثار هنر معاصر حمایت نموده است.

Protection of Contemporary Artistic Works under United States’ Case Law

Contemporary artistic works are a part of art that because of their particular nature cannot be fitted into the definition and requirements of traditional art. Such works fit uneasily into the concepts of originality, ideaexpression dichotomy and fixation as conventional copyrights works do. This results in lack or inadequacy in protection of these works within national and international laws. Since some claim that the originality as a condition for protection in its traditional sense is absent in contemporary artistic works, a significant number of cases have been filed as such works in many cases infringe the rights of previous right holders. Citing the fair use doctrine under section 107 of United States’ copyright act 1976, United States’ case law tend to protect contemporary artistic works. This Article tries to clarify the differences between the characteristics of such works with the requirements defined at international level for protection and examine the United States' case law to find how and under what conditions contemporary artistic works can be protected with the fair use doctrine.
