تحلیل حقوقی جبران خسارت ناشی از صدمات بدنی ناشی از حوادث پزشکی

زمینه و هدف: صدمات بدنی ناشی از حوادث پزشکی از موضوعات مهم و مبتلا‌به جامعه است که جبران خسارت ناشی از آن نیازمند بحث و بررسی است. بر همین اساس هدف مقاله حاضر تحلیل حقوقی جبران خسارت ناشی از صدمات بدنی ناشی از حوادث پزشکی است.روش: استفاده از روش توصیفی تحلیلی و با به کارگرفتن شیوه جمع‏آوری اطلاعات به صورت کتابخانه‏ای.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: برخی از نظام‌های جبران خسارت، جامع تمامی انواع حوادث و در نتیجه تمامی صدمات درمانی هستند؛ در برخی دیگر تنها زیان‌هایی که در قانون مورد تصریح قرار گرفته‌اند، تحت پوشش قرار می‌گیرند و گستره آن‌ها اعم از حوادث پزشکی است؛ برخی نیز تنها حوادث پزشکی و زیان‌هایی را جبران می‌کنند که ماهیتی اتفاقی دارند و در این بین نیز شروط محدودکننده خاصی وضع می‌کنند و به عنوان نمونه تنها قربانیان حوادث پزشکی شدید و نادر را تحت حمایت قرار می‌دهند. در نظام حقوقی ایران در خصوص پزشک و مسئولیت پزشکی، قانونی خاص وجود ندارد و دادگاه‌ها بر اساس قوانین عام مسئولیت مدنی و جزایی حکم صادر می‌کنند.نتیجه‌گیری: با توجه به شمار روزافزون قربانیان حوادث پزشکی و فقدان مبنای قانونی لازم برای جبران خسارت آن‌ها لازم است تحولی در نظام حقوق مسئولیت مدنی ایران صورت بگیرد که هدف حمایت از قربانیان و جبران خسارت بدون قید و شرط آن‌ها را به بهترین نحو محقق گرداند. بنابراین لازم است نظام خاص جبران خسارت در زمینه زیان‌های پزشکی ایجاد شود.

background and aim: bodily injuries caused by medical accidents are one of the important issues affecting society, and compensation for the resulting damage needs to be discussed and investigated. based on this, the aim of this article is the legal analysis of compensation for physical injuries caused by medical accidents.method: using descriptive and analytical methods and employing library-based data collection methods.ethical considerations: in all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been respected.results: some comprehensive compensation systems cover all types of accidents and, of course, all medical injuries, while others cover only the losses specified in the law, and their range includes medical accidents, while some impose certain limiting conditions and for example only the victims of severe and rare medical accidents are protected. in iran's legal system, there is no special forensic medicine regarding medical and liability, and courts issue judgments based on general, civil, civil and criminal liability laws.conclusion: considering the increasing number of victims of medical accidents and the lack of legal enamel necessary to compensate them, it is necessary to make a change in the civil liability law system of iran, which will achieve the goal of protecting the victims and compensating them unconditionally in the best possible way; therefore, it is necessary to establish a special compensation system in the field of medical losses.
