ماهیت و اعتبارسنجی زیست‌سنج‌ها در کشف جرائم

زمینه و هدف: امروزه به تبع پیشرفت روزافزون تکنولوژی و اقبال عمومی در سراسر دنیا نسبت به بهره‌گیری از آن، رسیدگی‌های قضایی نیز با نوعی تحول و ترقی در به کارگیری ادله علمی از جمله علم بیومتریک مواجه شده است. این علم ابتدا با هدف زیست‌سنجی، ارتقای سیستم‌های کنترل دسترسی، حذف نگرانی‌های امنیتی و حفظ حریم خصوصی تولید شد، اما امروزه ابزار قابل اعتمادی برای احراز هویت بر اساس ویژگی‌های فیزیولوژیکی و رفتاری افراد می‌باشد. در گذشته، اثر انگشت اولین و تنها راه تشخیص هویت بود، ولی اکنون به کمک بیومتریک، سایر ویژگی‌های منحصر به فرد انسانی نیز مورد شناسایی قرار گرفته‌اند که البته در سیستم‌های قضایی مختلف، اعتبار و جایگاه متفاوتی دارند و در نتیجه علیرغم راهگشابودن و قبول اثربخشی این دلایل در تمام مراحل، از جمله کشف جرم و یا رسیدگی در دادسرا و دادگاه، همواره نیازمند تعیین دقیق اعتبار در سیستم قضایی هستند. پژوهش پیش رو درصدد است تا با شناسایی روش‌های کاربردی بیومتریک در کشف جرم، به اعتبارسنجی این روش‌ها بپردازد. در حقیقت این تحقیق با هدف ماهیت‌شناسی و بررسی اعتبار این روش‌ها نوشته شده است.روش: پژوهش پیش رو به شیوه نظری، با روش توصیفی تحلیلی و بهره‌گیری از اطلاعات کتابخانه‌ای (اعم از اسناد، کتب و مقالات) و بسترهای برخط مکتوب شده است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: علم زیست‌سنجی از منظر شناسایی انسان‌ها، در اکثر کشورهای دنیا، مورد توجه علوم مختلف بوده و روز به روز در حال پیشرفت و گسترش نیز است. این علم نه‌تنها در کشف جرایم و مجرمان، کاربرد فراوان دارد، بلکه در حوزه رسیدگی‌های حقوقی و گسترش امنیت بسیار اثرگذار است. بعضی از خصوصیات زیست‌سنجی، کاربرد بیشتری از ویژگی‌های انحصاری دیگر انسان، در کشف جرایم دارد. این علم با رویکرد تشخیص و شناسایی انسان‌ها، در نظام حقوقی ایران و فقه اسلامی به عنوان اماره قضایی که برای قضات علم‌آور است، پذیرفته شده و آن‌ها باید به استناد آن رای صادر کنند.نتیجه‌گیری: می‌توان با گسترش استفاده از علم زیست‌سنجی و تحقیقات بیشتر در این زمینه، در امور امنیتی و پیشگیری از وقوع و کشف جرم از آن بهره‌مند گردید. علم بیومتریک یکی از علوم کشف علمی جرائم است که می‌تواند برای قاضی نوعاً علم‌آور بوده و مستند علم قاضی در آرایی که صادر می‌کند، باشد و او را در حل پرونده‌ها به حق و عدالت، یاری رساند.

background and aim: today, according to the increasing progress of technology and the public interest all over the world towards its use, judicial proceedings have also faced a kind of development and progress in the use of scientific evidence, including biometric science. this science was first produced with the aim of biometrics, improving access control systems, removing security concerns and preserving privacy, but today it is a reliable tool for authentication based on the physiological and behavioral characteristics of people. in the past, fingerprints were the first and only way to recognize identity, but now, with the help of biometrics, other unique human characteristics have also been identified, which, of course, have different validity and status in different judicial systems and as a result, despite the pioneering the effectiveness and acceptance of these reasons in all stages, including the discovery of a crime or proceedings in the prosecutor's office and court, always require accurate determination of credibility in the judicial system. the upcoming research aims to validate these methods by identifying the biometric methods used in crime detection. in fact, this research was produced with the purpose of characterizing and checking the validity of these methods.method: the present research is theoretical, descriptive-analytical and using library information (including documents, books and articles) and written online platforms.ethical considerations: in all stages of writing the present research, the originality of the texts, honesty and trustworthiness have been observed.results: the science of biometrics from the point of view of identifying people, in most countries of the world, has been the focus of various sciences and is progressing and expanding day by day. this science is not only widely used in the detection of crimes and criminals, but also in the field of legal proceedings and the expansion of security are very effective. some of the characteristics of biometrics are more useful than other exclusive characteristics of humans in the detection of crimes. this science, with the approach of recognizing and identifying humans, is used in the legal system of iran and islamic jurisprudence as a judicial conclusive presumption. which is a source of knowledge for the judges, has been accepted and they should verdict base on it.conclusion: by expanding the use of biometrics and further research in this field, it can be used in security matters and crime prevention and detection. biometric science is one of the sciences of crime detection that can be typically scientific for a judge. be and document the knowledge of the judge in the verdicts he issues and helped him in resolving cases to the right and justice.
