تحلیل تطبیقی کنوانسیون حقوق افراد دارای معلولیت سازمان ملل با قانون حمایت از حقوق معلولان ایران

زمینه و هدف: تحلیل تطبیقی کنوانسیون حقوق افراد دارای معلولیت مصوب سازمان ملل در سال 2008 با قانون حمایت از حقوق افراد دارای معلولیت در ایران مصوب سال 1387 و بازنگری شده در سال 1396 است، هدف نویسندگان این مقاله بوده است.روش: روش تحقیق پژوهش مقایسه‌ای از نوع کیفی است و شیوه گردآوری اطلاعات، مطالعات کتابخانه‌ای است.ملاحظات اخلاقی: این مقاله کاملاً به اصول اخلاقی پژوهش، از جمله امانتداری علمی، رعایت حقوق و اصول مالکیت مادی و معنوی پایبند بوده است.یافته‌ها: یافته‌های پژوهش حاکی از آن است که قانون حمایت از حقوق معلولان در ایران در موارد متعددی مانند دامنه و هدف، چهارچوب حقوقی، مفاد کلیدی، مکانیسم‌های اجرایی و تاثیرات بین‌المللی، با کنوانسیون حقوق افراد دارای معلولیت سازمان ملل دارای وجوه تشابه و تفاوت بنیادین است.نتیجه‌گیری: نتایج مقاله نشان می‌دهد که اگرچه قوانینی در رابطه با حقوق افراد دارای معلولیت در ایران به تصویب رسیده است، اما این قوانین به میزانی حداقلی است و با استاندارهای جهانی در این زمینه فاصله زیادی دارد. نتایج همچنین موید این مساله است که بین چهارچوب قانونی و اجرای عملی قانون حمایت از حقوق معلولان شکاف عمیقی وجود دارد و رفع این شکاف برای اعتلای حقوق و رفاه افراد دارای معلولیت در ایران حیاتی است.

background and aim: the objective of this article is a comparative analysis of the united nations convention on the rights of persons with disabilities, adopted in 2008, with iran's law on the protection of the rights of persons with disabilities, originally passed in 2008 and revised in 2017.method: the research method used is a qualitative comparative study, and the information was gathered through library research.ethical considerations: this article adheres strictly to ethical research principles, including scientific integrity, and respect for material and intellectual property rights.results: the research findings indicate that iran's law on the protection of the rights of persons with disabilities shares both fundamental similarities and differences with the united nations convention on the rights of persons with disabilities in several areas, such as scope and objectives, legal framework, key provisions, implementation mechanisms, and international impacts.conclusion: the article concludes that although laws related to the rights of persons with disabilities have been enacted in iran, they are minimal and significantly lag behind global standards in this area. the findings also highlight a deep gap between the legal framework and the practical implementation of the law on the protection of the rights of persons with disabilities, emphasizing that bridging this gap is crucial for advancing the rights and welfare of persons with disabilities in iran.
