نگرشی تحلیلی بر مسئولیت مدنی ناشی از به کارگیری هوش مصنوعی در پزشکی با مطالعه تطبیقی

زمینه و هدف: هوش مصنوعی پزشکی می‌تواند تاثیر بسیار مثبتی در پیش‌بینی، تشخیص و درمان بیماری‌ها و مدیریت ریسک داشته باشد. با این ‌همه، چالش‌ها و مسائل حقوقی و اخلاقی زیادی را نیز به همراه دارد. در ارتباط با مسئولیت مدنی، مشکلاتی مانند جعبه‌سیاه، عدم شفافیت و پیش‌بینی‌پذیری باعث شده تا در این حوزه با «زیان‌های ناشناخته» رو به رو باشیم که قابلیت انتساب به عامل یا عوامل انسانی خاصی را ندارد و یا مربوط به اشتباهات گریزناپذیر انسانی است. از ‌این ‌رو لازم است قواعد و نظام خاصی برای پیشگیری، جبران و مدیریت ریسک‌های ناشی از به کارگیری هوش مصنوعی در عرصه پزشکی طراحی شود؛ موضوعی که در این تحقیق مورد بررسی قرار گرفته است.روش: این مقاله به روش توصیفی تحلیلی می‌باشد و با استفاده از منابع کتابخانه‌ای، با مراجعه به کتب، مقالات و قوانین موجود در این زمینه نگارش یافته است.ملاحظات اخلاقی: این تحقیق با تکیه بر اصول اخلاقی، امانتداری و صداقت نگارش یافته است.یافته‌ها: در شناسایی شخص یا اشخاص مسئول در موقعیت‌های ناشی از به کارگیری هوش مصنوعی، اعمال روش‌های سنتی انتساب مسئولیت، ناعادلانه و غیر عملی خواهد بود.نتیجه‌گیری: دشواری‌های اثبات تقصیر و انتساب مسئولیت به عامل انسانی و از طرفی لزوم جبران خسارت زیان‌دیده و توجه همزمان به رشد و توسعه فناوری در زمینه هوش مصنوعی، اهمیت توسل به ساز‌‌و‌کارهای جمعی جبران خسارت و توزیع ضرر در این حوزه را آشکار می‌سازد.

investigating the tort liability resulting from the use of artificial intelligence in medicine with a comparative study

background and aim: medical artificial intelligence has a very positive effect on the prediction and treatment of diseases. the use of artificial intelligence, apart from its very positive effects, due to the existence of challenges and issues such as black box, lack of transparency and predictability, is faced with a legal gap in relation to the attribution of responsibility in the event of causing damage. the occurrence of injury and damage to the body and life of people, to which person or persons can be attributed the responsibility is investigated in this research.method: this article is descriptive-analytical and has been written using library resources, referring to books, articles and laws in this field.ethical considerations: this research was written based on ethical principles, trustworthiness and honesty.results: th in identifying the person or persons responsible in situations caused by the use of artificial intelligence, applying traditional methods of attribution of responsibility will be unfair and impractical.conclusion: the difficulties of proving fault and attributing liability and on the other hand the necessity of respecting the rule of respect and compensating the victim reveal the importance of considering insurance or compensation fund in this regard.
