بررسی تحقق تدلیس در نکاح با جراحی زیبایی

زمینه و هدف: تدلیس در نکاح از موضوعات محل بحث و نظر است. هدف مقاله حاضر بررسی تدلیس در نکاح با جراحی زیبایی است.روش: مقاله مورد اشاره توصیفی تحلیلی بوده و از روش کتابخانه‌ای استفاده‌ شده است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: جراحی زیبایی به طور مطلق موجب وقوع تدلیس در نکاح نیست و نوعی که برای درمان است همواره مشمول عنوان تدلیس نمی‌شود. همچنین در مواردی که طرف عقد یا شخص دیگر با علم و عمده اطلاع و کتمان حقیقت و انکار باعث به اشتباه افتاده طرف مقابل شود، تدلیس محقق خواهد شد. در صورتی جراحی پلاستیک منجر به تدلیس در ازدواج می‌شود که باعث فریب طرف مقابل شود و به طرق مقابل ضرر و خسارتی را وارد کند و یا حقی از وی زائل نماید.نتیجه‌گیری: جراحی زیبایی در صورتی‌ که موجب کتمان یک عیب غیر قابل ‌گذشت گردد، تدلیس بوده و طرف مقابل می‌تواند نکاح را فسخ نماید.
