تاثیر اختلالات رفتاری ترانس سکشوال‌ها بر مسئولیت کیفری آن‌ها نسبت به جرائم جنسی

زمینه و هدف: ترانس سکشوال نوعی اختلال جنسیت است که در آن جنسیت ظاهری فردِ ترانس معارض با جنسیت درونی و واقعی اوست. به رسمیت‌شناختن جنسیت واقعی ترانس سکشوال‌ها می‌تواند ثمرات و کاربرد قابل توجه نسبت به بزه‌دیدگی و بزه‌کاری این افراد داشته باشد، به ویژه در جرائم جنسی، لذا در این تحقیق هدف نگارنده، بررسی جایگاه ترانس سکشوال‌ها در قوانین جزایی ایران و ارائه راهکارهای فقهی و حقوقی جهت کاهش تعزیر یا استثنانمودن آن‌ها از اجرای حدود در جرائم جنسی است. اهمیت و ضرورت اجرای تحقیق حاضر در این است که دستاورد آن می‌تواند توجیهی شرعی و قانونی جهت ممانعت از اعمال حدود سالب حیات، مانند لواط، باشد، لذا بحث اصلی تحقیق حاضر عبارت است از اینکه مبنا و ملاک مناسب مجازات ترانس سکشوال‌ها در جرائم جنسی چیست؟روش: این تحقیق از نوع نظری بوده و روش تحقیق به صورت توصیفی تحلیلی می‌باشد و روش جمع‌آوری اطلاعات به صورت کتابخانه‌ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: جنسیت ظاهری افراد ترانس با جنسیت درونی آن‌ها مغایرت دارد، به نحوی که یک ترانس به ظاهر مرد از حیث ساختار مغزی و هورمونی و رفتار روانی و عصبی زن محسوب می‌شود. این تعارض و مغایرت، بنا بر اصول و قواعد فقهی و حقوقی می‌تواند مسقط حد باشد و ضرورت تقنین خاص در شرایط خاص را به همراه دارد، از طرفی در تغییر جنسیت نیز مراجع و قانونگذار جنسیت درونی را به رسمیت شناخته‌اند، لذا می‌توان در امور کیفری نیز جنسیت درونی را لحاظ نمود.نتیجه‌گیری: با توجه به مغایرت جنسیت ظاهری و واقعی فرد ترانس و بنا بر اصول و قواعد فقهی و حقوقی، عدالت اقتضا دارد که حداقل در جرائم جنسیِ ترانس سکشوال‌ها، جنسیت واقعی آن‌ها ملاک قرار گیرید، چراکه این امر می‌تواند اسقاط حد و یا اعمال حداقل مجازات را به همراه داشته باشد. در انتها نیز ضمن پیشنهاد اصلاح قوانین، راهکارهایی برای نحوه اثبات ماهیت ترانس سکشوال‌ها ارائه شده است، مانند آزمایش پزشکی، صدور کارت تشخیص جنسیت واقعی، ثبت و رصد رفتار ترانس‌ها و... .

background and aim: transsexual is a type of gender disorder in which the trans person's outward gender is in conflict with his or her real gender. recognizing the true gender of transsexuals can have significant results in relation to the victimization and delinquency of these people، especially in sexual crimes. therefore، in this research، the author's goal is to investigate the position of transgenders in iran's criminal laws and to present jurisprudential and legal solutions to reduce punishment in sexual crimes. the importance and necessity of conducting the present research is that its achievement can be a legal justification for preventing the execution. therefore، the main discussion of the current research is what is the basis and criteria for punishing transgenders in sexual crimes?methods: this research is theoretical and the research method is descriptive and analytical. and the method of collecting information is in the form of a library and is done by referring to documents، books and articles.ethical considerations: in all stages of writing the present research، while respecting the originality of the texts، honesty and trustworthiness have been observed.results: the apparent gender of trans people is different from their real gender، in such a way that an apparently male trans person is considered a woman in terms of brain and hormonal structure and mental and nervous behavior. it brings the necessity of specific legislation in specific circumstances، on the other hand، in gender change، religious scholars and legislators have recognized the real gender. therefore، internرal gender can also be considered in criminal matters.conclusion: the discrepancy between the apparent and real gender of trans people، and according to jurisprudence and legal principles and rules، the justice of necessity is that at least in the sexual crimes of transsexuals، their real gender should be the criterion، because this can remove or reduce the punishment. in the end، along with proposing to amend the laws، solutions have been provided to prevent possible abuses، such as medical tests، issuing true gender identification cards، recording and monitoring the behavior of trans people، etc.
