تضمین «حق دادخواهی کودکان توانخواه» در برابر خشونت خانگی؛ چالش‌ها و راهکارها

زمینه و هدف: در جامعه امروز، خشونت خانگی به عنوان یکی از مشکلات اجتماعی بسیار شایع است و کودکان نیز از این خشونت‌ها به شدت تحت تاثیر قرار می‌گیرند. بنابراین تضمین حق دادخواهی کودکان توانخواه در برابر خشونت خانگی بسیار حائز اهمیت است.روش: این مقاله از نظر هدف کاربردی است و چالش‌های موجود در این زمینه از طریق روش توصیفی تحلیل و با استفاده از ابزار کتابخانه‌ای بررسی شده و راهکارهایی برای حفظ حقوق کودکان قربانی خشونت خانگی ارائه شده است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصول متون، صداقت و امانتداری رعایت شده است.یافته‌ها: از جمله راهکارهای پیشگیری از خشونت خانگی علیه کودکان توانخواه و تامین عدالت برای قربانیان که در این مقاله ارائه شده است، عبارت است از تدارک آموزش‌های ویژه برای کودکان توانخواه و کارکنان حوزه دادگستری، افزایش آگاهی عمومی، حذف یا اصلاح قوانین خشونت‌زا، لزوم دسترسی به داده‌های آماری تفکیک‌شده، تضمین دسترس‌پذیری و همسان‌سازی متعارف در برنامه‌های حمایتی و بازدارنده، پیروی از توصیه‌های کمیته حقوق افراد دارای معلولیت به کشور‌های عضو، حضور سازمان‌های مردم‌نهاد و حل‌ و فصل اختلافات به صورت بر‌خط که در متن مقاله بدان پرداخته شده است.نتیجه‌گیری: به طور کلی، تضمین حق دادخواهی کودکان توانخواه در برابر خشونت خانگی نیازمند همکاری و هماهنگی بین دولت، جامعه و خانواده‌ها است. با اجرای راهکارهای مناسب، می‌توان این حق را برای کودکان قربانی خشونت خانگی تضمین کرد و از آن‌ها در برابر تاثیرات منفی این خشونت‌ها محافظت کرد.

background and aim: in today's society, domestic violence is very common as one of the social problems and children are also greatly affected by this violence. therefore, it is very important to guarantee the right of vulnerable children to sue against domestic violence. methods: this article is practical in terms of its purpose and the challenges in this field areexamined through the descriptive-analytical method and using library tools and solutions arepresented to protect the rights of children who are victims of domestic violence.ethical considerations: in all stages of writing the present research, while respecting the originality ofthe texts, honesty and trustworthiness have been observed.results: among the solutions to prevent domestic violence against disabled children and provide justicefor the victims that are presented in this article are the provision of special training for disabled childrenand employees of the judiciary, increasing public awareness, removing or amending violent laws, the needto access disaggregated statistical data, guaranteeing accessibility and conventional assimilation insupport and prevention programs, following the recommendations of the committee on the rights ofpersons with disabilities to member countries, the presence of non-governmental organizations andresolving disputes online, which are discussed in the text of the article.conclusion: in general, guaranteeing the right of vulnerable children to sue against domestic violencerequires cooperation and coordination between the government, society and families. by implementingappropriate strategies, this right can be guaranteed for children who are victims of domestic violence andprotect them from the negative effects of this violence.
