راهکارهای حقوقی چالش‌های فناوری زیست‌پزشکی بر اساس موازین حقوق بشر

زمینه و هدف: زیست‌پزشکی از جهات مختلف، از جمله تاثیر بر موازین حقوق بشر محل بحث و نظر است. یکی از مباحث مهم در این خصوص نادیده‌گرفته‌شدن موازین حقوق بشری در فرایند فناوری زیست‌پزشکی است. بر همین اساس هدف مقاله حاضر بررسی چالش‌های فناوری زیست‌پزشکی برای موازین بنیادین حقوق بشر است برای اینکه راهکارهای حقوقی برای برون‌رفت از چالش‎ها ارائه نماید.روش: مقاله مورد اشاره توصیفی تحلیلی بوده و از روش کتابخانه‌ای استفاده ‌شده است.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، اصالت متون، صداقت و امانتداری رعایت شده است.یافته‌ها: نقض کرامت انسانی، ایجاد تبعیض و عدم رعایت برابری میان افراد، عدم سودرسانی عمومی و نادیده‌گرفتن اصل رضایت آزادانه و آگاهانه از چالش‌هایی است که فناوری زیست‌پزشکی برای موازین حقوق بشر به همراه دارد. متعهدساختن کشورها، سازمان‌های بین‌الملل و شرکت‌های فعال در عرصه فناوری زیست‌پزشکی با وضع قوانینی که ضمانت اجرا دارد، مهم‌ترین راهکارهای حقوقی در این زمینه است.نتیجه‌گیری: با توسعه روزافزون زیست‌فناوری در علوم پزشکی و سکوت و اجمال و تعارض و نقص قوانین موجود در پاسخگویی به مشکلات مطرح در این حوزه و لزوم دفاع و حمایت از حیثیت و کرامت انسان در مقابل سوءاستفاده‌های علمی و صیانت از حقوق بشر، لزوم دخالت دولت و قانونمندی فعالیت‌های این حوزه و به روزآوری قوانین و مداخله در ساماندهی و حراست از ارزش‌های والای انسانی در مقابل سوءاستفاده‌های علمی، محرز است.

background and aim: biomedicine is a subject of discussion and opinion from different aspects، including the impact on the standards of human achievement. one of the important topics in this regard is the neglect of human rights standards in the biomedical technology process. accordingly، the purpose of this article is to examine the challenges of biomedical technology for the fundamental standards of human rights in order to provide legal solutions to overcome the challenges.methods: the mentioned article is descriptive and analytical and the library method is used.ethical considerations: in all stages of writing the present research، the originality of the texts، honesty and trustworthiness have been observed.results: violation of human dignity، discrimination and non-respect of equality between people، lack of public respect and ignoring the principle of free and informed consent are some of the challenges that biomedical technology brings to human rights standards.conclusion: with the increasing development of biotechnology in medical sciences and the silence، brevity، conflict، and deficiency of existing laws in responding to the problems raised in this field and the need to defend and protect human dignity and human rights against scientific abuses of human rights، the need to intervene the government and legality of the activities in this field and the updating of the laws and intervention in the organization and protection of high human values against scientific abuses are certain.
