تاثیر مولفه حق سلامت کودکان بر قابلیت استنادپذیری داده‌ها و سوابق الکترونیک

زمینه و هدف: پس از ورود فناوری‌های نوین اطلاعاتی بر زندگی مردم، کم‌کم آثار این ارمغان، بر جنبه‌های متعدد زندگی از جمله حقوق کودک هویدا گردید. به همین منظور در عصر حاضر نیاز به واکاوی موضوعاتی است که در نتیجه آن بتوان حقوقی را که از کودکان برحسب وجود فضای اطلاعاتی نوین تحت عنوان فضای مجازی، مورد همجه و تحدید قرار گرفته، احیا نمود. در فضای مجازی کودک با داده ها و سوابق الکترونیکی بسیاری مواجه می شود که ممکن است سلامت جسمی، روحی و روانی و متعاقباً آینده فردی و حیثیتی وی را تهدید نماید. هدف از این تحقیق  بررسی شرایطی است که قابلیت استنادپذیری داده ها و سوابق الکترونیک به لحاظ حمایت از حق سلامت کودک تحت تاثیر قرار می گیرد. مواد و روش‌ها: این پژوهش، یک مطالعه توصیفی تحلیلی آینده نگر است. جامعه مورد مطالعه کودکان و نوجوانان با نگاه به حق سلامت آن ها در فضای مجازی در حال و آینده است که یا خود به نوعی با فضای مجازی ارتباط برقرار می کنند یا اطلاعات آن ها توسط دیگران در این فضا ثبت و ضبط می گردد. یافته‌ها: ثبت و ذخیره نامحدود اطلاعاتی از کودکان توسط موسسات آموزشی، ورزشی، فرهنگی و برخی سایت های مرتبط ممکن است آتیه هویتی وی را دچار خدشه و نقصان نماید زیرا با انتشار مطالب در فضای مجازی، به نوعی سند و دلیلی از یک واقعه در یک فضای لایتناهی تولید می‌گردد که حذف آن تقریباً غیرممکن است که این امر می تواند از موارد نقض حق سلامت کودک باشد.ملاحظات اخلاقی: صداقت و امانت‌داری در تحلیل متون و استناددهی رعایت گردید. نتیجه‌گیری: این مطالعه نشان داد چنانچه داده‌‌ها و سوابق الکترونیک در فضای مجازی، مولفه حق سلامت کودکان را در مواردی از قبیل ارائه، دسترسی و جمع آوری داده‌‌ها، تبلیغ و حسن نیت، رعایت نکنند قابلیت استنادپذیری و اعتبار داده‌‌ها و سوابق الکترونیک ناممکن تلقی و از نظر اجرای مفاد و سایر آثار در حکم اسناد معتبر و قابل استناد در مراجع قضائی و حقوقی تلقی نمی‌شوند.

The Effect of Children's Right to Health Component on Data Citation Capability and Electronic Records

Background and Aim: After entering the new information technology, information about people’s lives, little by little, this gift has been made in many aspects of life, including the rights of the child. For this reason, in the present age, there is a need for research topics, as a result of which, if it has rights, if children in cyberspace are subject to cyberspace conditions, it will be referred to as cyberspace and will be revived. In cyberspace, the child encounters a lot of electronic data and records that may threaten his physical, mental and emotional health and consequently his personal and dignity future. The purpose of this study is to investigate the conditions that affect the reliability of data and electronic records in terms of protecting the child’s right to health.Materials and Methods: This research is a prospective descriptive analytical study. The study population is children and adolescents with a view to their right to health in cyberspace now and in the future, who either interact with cyberspace in some way or their information is recorded by others in this space.Results: Unlimited registration and storage of information about children by educational, sports, cultural institutions and some related sites may damage their identity because by publishing content in cyberspace, it becomes a kind of document and reason for an event in an infinite space. It is almost impossible to remove, which can be a violation of the child’s health.Ethical considerations: Honesty and fidelity were observed in the analysis of texts and citations.Conclusion: This study showed that if electronic data and records in cyberspace do not comply with the component of children’s right to health in matters such as presentation, access and collection of data, publicity and good faith, the reliability and validity of electronic data and records are considered impossible.
