حقوق نظام تامین اجتماعی ایالات متحده آمریکا

زمینه و هدف: حق برخورداری از تامین اجتماعی یکی از مهم‌ترین حقوق انسان‌هاست که در اسناد حقوق بشر، تعهدات بین‌المللی دولت‌ها و نیز قوانین اساسی مورد تاکید قرار گرفته است. آگاهی داشتن جوامع از حقوق تامین اجتماعی نقش بسزایی در عدالت اجتماعی، آرامش خاطر و عزت نفس در افراد جامعه و حمایت از آنان در برابر کلیه مخاطرات ناشی از بحران‌های اقتصادی، اجتماعی و فرهنگی دارد. امروزه با افزایش سریع جمعیت، پیچیدگی مسائل و وسعت نیاز این حقوق از اهمیت اقتصادی، سیاسی و اجتماعی بسیار بالایی برخوردار شده و از شاخص‌های مهم توسعه و پیشرفت در کشورهای جهان محسوب می‌گردد. مواد و روش‌ها: در این تحقیق با بهره گیری از روش توصیفی-تحلیلی به جمع آوری اطلاعات از طریق بررسی کتب، مقالات و پایان نامه ها و مراکز پژوهشی و اینترنت پرداخته شده و سپس پردازش داده ها و اطلاعات گردآوری شده با استفاده بهینه، استدلالی و عقلی برای ارائه مطالب و نتایج پژوهش مرتبط مورد توجه قرار گرفته است. یافته‌ها: تکوین نظام حقوقی تامین اجتماعی یک ضرورت به‌حساب می‌آید و تدوین و تکمیل این نظام حقوقی مستلزم احراز اصول اساسی قابل قبول توسط حاکمیت و مردم است. این نظام حقوقی به منظور تحقق اهداف و استاندارها و راهبردهای ارزشیابی از لحاظ ساختاری و تقنینی، نظام دادرسی، بیمه‌ای، خدمات درمانی، حوزه سلامت و بهداشت، حمایت‌های امدادی از قبیل بیمه بیکاری و از کار افتادگی و تامین منابع مالی بسیار جامع، پویا و کارامد است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه‌گیری: برنامه تامین اجتماعی ایالات متحده شامل سه جزء است که عبارت‌اند از: کمک‌های بازنشستگی، از کار افتادگی و کمک به بازماندگان. در این کشور طرح پرداخت مستمری‌ها به سه روش ذیل انجام می‌شود: مستمری مبتنی بر پرداخت حق بیمه، مستمری همگانی و مستمری تکمیلی مبتنی بر بررسی درآمد که پرداخت حداقل مقرری را برای کلیه‌ی مستمری بگیران تضمین می‌نماید.
