رابطه سببیت میان افعال پزشک و ایراد صدمه به سقط جنین در قانون مجازات اسلامی

زمینه و هدف: مسوولیت پزشک در نظام حقوق اسلام پیشینه چندانی ندارد و فقط می‌توان با استفاده از آرای پراکنده فقها در میان کتب فقهی چون دیات و قصاص و... احکامی را به دست آورد. این تحقیق ضمن بررسی اقوال فقها مواد قانون مجازات اسلامی و دیگر قوانین مانند قانون آیین دادرسی کیفری و قانون انتظامی پزشکان در ارتباط با رابطه سببیت میان افعال پزشک و ایراد صدمه به جنین مورد شرح و بررسی قرار داده است.مواد و روش‌ها: این تحقیق از نوع نظری بوده، ‌روش تحقیق به صورت توصیفی تحلیلی می‏ باشد و روش جمع‏ آوری اطلاعات به صورت کتابخانه‏ ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.یافته‌ها: بررسی ادله فقهی میزان و آثار مسوولیت ناشی از اقدامات پزشک با توجه‌ به شیوع و مورد ابتلا‌بودن‌ آن مد نظر فقها قرار گرفته است. فقها بر مسوول‌بودن پزشک جاهل مقصر که در کار خود تخصص لازم را ندارد یا در طبابت کوتاهی کرده و پزشکی که با وجود‌ داشتن تخصص کافی، برای درمان اجازه نداشته است، اتفاق نظر دارند.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.نتیجه‌گیری: این آرا خود به چند دسته و برداشت تقسیم شده و مبنای مسوولیت پزشک را مشخص می‌سازند. از طرفی گروهی کثیری به ضمان پزشک به طور مطلق قائلند و گروهی دیگر با تمسک به دسته‌ای از ادله مانند قاعده احسان و برائت پزشک را فاقد مسوولیت فرض می‌نمایند و گروهی دیگر که قائل به تفصیل میان قصور و غیر آن شده‌اند. قانون مجازات اسلامی 1392 با تصحیح برخی از مواد قانون مجازات 1375 نظر تعدیل‌شده‌ای را ارائه کرده است.

The Relationship between Causes of Physician Verbs and Abortion Damage in Islamic Penal Code

Background and Aim: The responsibility of the physician in the Islamic system of law has little background and can only be obtained by using the disseminated opinions of jurists in jurisprudential books such as diat, qisas, and so on. This study, while examining the sayings of the jurists, has explained the articles of the Islamic Penal Code and other laws such as the Code of Criminal Procedure and the Disciplinary Law of Physicians in relation to the causal relationship between physician actions and causing harm to the fetus.Materials and Methods: This research is of theoretical type and the research method is descriptiveanalytical and the method of data collection is library and has been done by referring to documents, books and articles.Results: Evaluation of jurisprudential arguments about the extent and effects of responsibility arising from the actions of the physician with regard to its prevalence and its prevalence has been considered by jurists. Jurists disagree on the responsibility of the blameworthy physician who does not have the necessary expertise or shortage of medical practice and the physician who, despite having sufficient expertise, is not allowed to receive treatment.Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Conclusion: These opinions themselves are divided into several categories and perceptions and determine the basis of the physician’s responsibility. On the one hand, a large group of physicians who absolutely agree with the physician, and another group with no focus on a set of arguments, such as the rule of eligibility and physician liability, assume no responsibility. And another group that elaborated on the difference between failure and nonfailure.
