سیاست جنایی بزه‌دیده‌مدارانه درخصوص بیماران مبتلا به ایدز با نگاهی به قوانین آمریکا

زمینه و هدف: بیماران مبتلا به ایدز مثل دیگر شهروندان جامعه از حق و حقوقی برخوردارند اولین موردی که می‌توان از آن به عنوان جلوه حمایتی و بزه‌دیده‌مدارانه از افراد مبتلا به ایدز نام برد حمایت از حق سلامت این دسته از بزه‌دیدگان است که از آن تحت عنوان سیاست جنایی بزه‌دیده‌مدارانه یاد می‌شود و این حق از مصادیق حقوق بنیادین بشر به شمار می‌رود در صورت مبتلا شدن شخصی به یک ویروس، نباید حقوق اساسی مبتلایان به آن را نادیده انگاشت، زیرا به جهت اینکه ایدز در اغلب جوامع به عنوان یک بیماری ننگ‌آور مطرح است باعث عدم پذیرش بیمار در خانواده و اجتماع می‌شود. هدف ما در این تحقیق بیان حقوق و ضمانت اجراهایی کیفری که در زمینه سیاست بزه‌مدارانه بیماران مبتلا به ایدز مطرح می‌گردد و رفع خلاهای قانونی در این زمینه می‌باشد. مواد و روش‌ها: این مقاله به صورت توصیفی-تحلیلی می‌باشد و با روش کتابخانه‌ای، با بهره‌گیری از ابزار فیش‌برداری تهیه و تدوین گردیده است. ملاحظات اخلاقی: در این مقاله از ابتدا تا انتها به اصول اخلاقی؛ صداقت، رازداری، اصل رعایت حقوق، اصل مالکیت مادی و معنوی پایبند می‌باشد. یافته‌ها: یافته‌های تحقیق حاکی از این است که؛ این بیماری به لحاظ ایجاد مشکلات اجتماعی فراوان، تفکرات سوء حاکم بر جامعه و انگ اجتماعی، نه‌تنها از جنبه سلامت جسمانی بلکه از بعد سلامت روانی و اجتماعی نیز وضعیت بیماران را متاثر کرده و منجر به بروز مشکلات عدیده در فعالیت‌های مفید و علایق بیماران می‌گردد. نتیجه‌گیری: با وجود مشکلاتی که برای مبتلایان وجود دارد بنابراین ضروری است که در این زمینه سیاست جنایی بزه‌دیده‌مدارانه راجع به بیماران مبتلا به ایدز با الگوبرداری از کشورهای پیشرو در این زمینه خاصه کشور امریکا می‌باشیم تجربه تبعیض در زمینه‌های مختلفی همچون تبعیض در حق برخورداری از درمان مناسب، حق اشتغال، حق آزادی در رفت و آمد و مهاجرت و ... . علاوه بر تاثیر منفی بر سلامت جسم و روان بیمار موجب مخفی نمودن بیماری و عدم مراجعه به درمان و درنتیجه افزایش این بیماری خواهد شد. فلذا دخالت نهادهای قانونگذاری و اعمال سیاست‌های کیفری در رابطه با نقض‌کنندگان حقوق اساسی مبتلایان ایدز می‌توان تا حدودی مانع افزایش سرعت شیوع ایدز گردید از سوی دیگر با توجه به سابقه پژوهش و پیش‌بینی قوانین حمایتی در ایالات متحده امریکا، در این نوشتار به بررسی مقررات فعلی و نواقص احتمالی موجود درخصوص حقوق حمایتی از بزه‌دیدگان مبتلایان به ایدز از جمله حق کار، حق بر سلامت، حق بر دادرسی عادلانه با نگاهی به مقررات ایالات متحده امریکا پرداخته شده است.

Victim-Oriented Criminal Policy in Respect to the Patients With AIDs Through a Glance at the US Regulations

Background and Aim: Patients With AIDS Have the Same Rights as Other Citizens of the Society. The First Thing That Can be Mentioned as a Manifestation of Support and Tolerance for Victims of AIDS is the Protection of the Right to Health of This Group of Victims, Which is Referred to as VictimOriented Criminal Policy. This Right is one of the Fundamental Human Rights. If a Person is Infected With a Virus, the Basic Rights of Those Infected With it Should not be Ignored, Because Because AIDS is Considered as a Disgraceful Disease in Most societies, it Causes the Patient not to be Admitted. It Happens in the Family and the Community. Our Aim in this Study is to Express the Rights and Guarantees of Criminal Executions in the Field of Criminal Policy of AIDS Patients and to Fill the Legal Gaps in this Field.Materials and Methods: This Article is DescriptiveAnalytical and has been Prepared and Compiled by the Library Method, Using Phishing Tools.Ethical Considerations: In This Article, From the Beginning to the End, It Adheres to the Principles of Ethics, Honesty, Confidentiality, the Principle of Observance of Rights, the Principle of Material and Intellectual Property.Findings: The Findings of the Study Indicate that this Disease in Terms of Causing Many Social Problems, Negative Thoughts Governing Society and Social Stigma, not Only in Terms of Physical Health but Also in Terms of Mental and Social Health Affects the Condition of Patients and Leads to Many Problems in It is Useful Activities and Interests of Patients.Conclusion: Despite the Problems that Exist for Sufferers, it is Therefore Essential That we Pursue a Criminalized VictimOriented Criminal Policy on AIDS Patients, Following the Example of Leading Countries in This Field, Especially the United States. Experiencing Discrimination in Various Areas, Such as Discrimination in Access to Appropriate Treatment. The Right to Employment, the Right to Freedom of Movement and Immigration, Etc. In Addition to the Negative Impact on the Patient’s Physical and Mental Health, it Will Hide the Disease and not Seek Treatment, thus Increasing the Disease. Therefore, the Involvement of Legislatures and the Implementation of Penal Policies in Relation to Violators of the Fundamental Rights of People Living With AIDS can be Somewhat Prevented From Accelerating the Spread of AIDS.
