مسئولیت دولت‌ها در قبال آلودگی‌های زیست محیطی در پرتو سلسله مراتب هنجاری نظام حقوق بین‌الملل

زمینه و هدف: ممنوعیت آلودگی محیط زیست و حق بر داشتن محیط زیست سالم، از نظر موضوعی جزئی از قلمرو حقوق بشر بین المللی محسوب می شوند. در فضای حقوق بشر بین المللی، جایگاه هنجارهای مختلف، متفاوت است. هدف اصلی در این پژوهش، بررسی ممنوعیت آلودگی محیط زیست در نظام حقوق بشر بین المللی و سلسله مراتب هنجاری آن می باشد. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می ‏باشد و روش جمع‏ آوری اطلاعات بصورت کتابخانه‏ ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: یافته های پژوهش حاضر نشان می دهد که با در نظر گرفتن اهمیت و جایگاه محیط زیست و ممنوعیت آلودگی آن و نیز ارتباط نزدیک آن با مصادیق مسلم قواعد آمره بین المللی مانند حق بر حیات، ممنوعیت توسل به زور و تجاوز و همچنین رویه بازیگران بین المللی (اعم از دولتی و غیردولتی)، این ظرفیت وجود دارد که ممنوعیت آلودگی محیط زیست را مصداقی از قواعد آمره حقوق بین الملل قلمداد نمود. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه‌گیری: به نظر می رسد که درنظر گرفتن سازوکار مسئولیت مشدد برای دولت ها و درنظر گرفتن تعهداتی برای سایر اعضاء جامعه بین المللی در موارد آلودگی های گسترده محیط زیست، منطبق با اصل مشارکت (که یکی از اصول بنیادین حقوق محیط زیست می باشد) است.

Responsibility of governments for environmental pollution in the light of the normative hierarchy of the international legal system

Background and Aim: Prohibition of environmental pollution and the right to a healthy environment are thematically part of the realm of international human rights. In the international human rights environment, the position of different norms is different. The main purpose of this study is to investigate the prohibition of environmental pollution in the international human rights system and its normative hierarchy.Materials and Methods: This research is of theoretical type and the research method is descriptiveanalytical and the method of data collection is library and has been done by referring to documents, books and articles.Results: The findings of the present study show that considering the importance and status of the environment and the prohibition of pollution, as well as its close relationship with certain examples of international rules such as the right to life, prohibition of use of force and aggression, as well as the practice of international actors (Both states and nonstates), there is a capacity to make the prohibition of environmental pollution an example of the rule of international law.Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Conclusion: It seems that considering the mechanism of aggravated responsibility for governments and considering the obligations of other members of the international community in cases of widespread environmental pollution is in line with the principle of participation (which is one of the fundamental principles of environmental law).Cite this article as: Moghofei M, Ranjbar I, Azadbakht F.
