دولت رفاه و آموزش و پرورش رایگان با توجه به اصول قانون اساسی جمهوری اسلامی ایران

زمینه و هدف: در قوانین بیشتر کشورهای جهان آموزش بدون هزینه و عمومی است و از حقوق اساسی شهروندان به حساب می آید. براساس نظرات حقوق دانان حق آموزش و پرورش رایگان و اجباری برای کودکان در قامت یک اصل کلی قابل پذیرش می باشد. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‏ باشد و روش جمع‏ آوری اطلاعات بصورت کتابخانه‏ ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: علیرغم اینکه در قانون اساسی بر رایگان بودن و آسانی در آموزش محصلین در مدارس تاکید شده، لیکن با وجود قوانین پر از قید و بند، عدم بررسی‌های لازم، دوگانگی در گفتار و کردار مقامات مسئول مخارج تحصیل را به عهده قشرهای متوسط و مستضعف می گذارد. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.نتیجه‌گیری: با عنایت به موقعیت حاکم بر مدارس و عدم بازرسی مکفی در رابطه با گرفتن پول به بهانه‌های متفاوت از اولیا دانش‌آموزان در مدارس دولتی همواره از اجرای اصل سی‌ام قانون اساسی دور و دورتر می‌شویم و تساوی و برابر آموزشی که از اصول قانون اساسی و دولت رفاه می‌باشد دچار خواب عمیق و فراموشی می‌شود.

Welfare State and free education according to the principles of the Constitution of the Islamic Republic of Iran

Background and Aim: In the laws of most countries of the world, education is free and public and is considered a fundamental right of citizens. According to jurists, the right to free and compulsory education for children is a generally accepted principle.Materials and Methods: This research is of theoretical type and the research method is descriptiveanalytical and the method of data collection is library and has been done by referring to documents, books and articles.Results: Despite the fact that the constitution emphasizes free and easy education of students in schools, but despite the restrictive laws, the lack of necessary investigations, the duplicity in the speech and actions of officials responsible for education costs to the middle and poor.Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Conclusion: Given the current situation in schools and the lack of adequate inspections in connection with taking money under various pretexts from parents of students in public schools, we are always moving away from the implementation of the thirtieth principle of the Constitution and the equality of education, which is one of the principles of the constitution and the welfare state, falls into a deep sleep and is forgotten.Cite this article as: Badihi M, Masoud GH, Atrian F.
