آثار تحریم ها از منظر تعهدات بین المللی زیست محیطی با تاکید بر مساله ایران

زمینه و هدف: تحریم ها در حقوق بین‌الملل، مجموعه ای از اقدامات با ماهیت اجباری هستند که هدف آنها وادار ساختن دولت‌ها، بازیگران بین المللی یا افراد غیرمتعهد به رعایت هنجارهای حقوق بین الملل یا پیروی از خواست و سیاست مورد نظر نهاد صادرکننده تحریم می باشد. هدف این پژوهش نشان دادن پیامدهایی است که تحریم های بین المللی برای محیط زیست به دنبال دارد. همچنین تلاش می شود، با توجه به اهمیت حفظ محیط زیست، یکپارچگی آن و نیز تعهدات کشورها و سازمان های بین المللی مختلف در حفظ و بازسازی محیط زیست و نیز حقوق بنیادینِ به رسمیت شناخته شده انسان ها در اسناد بین المللی، با توجه به پیامدهای زیست محیطی تحریم ها، میزان سازگاری آنها با این تعهدات و حقوق بنیادین سنجیده شود. مواد و روش‌ها: این تحقیق از نوع نظری بوده، روش تحقیق به صورت توصیفی تحلیلی می باشد، روش جمع آوری اطلاعات به صورت کتابخانه ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.یافته‌ها: اعمال تحریم ها در مورد ایران زمینه ساز پیامدهای منفی بر محیط زیست نظیر کاهش منابع درآمد ارزی دولت بر اثر محدودیت در فروش نفت، ایجاد محدودیت در انتقال دانش و فناوری، محدودیت در واردات بنزین، اخلال در روند آموزشی دانشجویان ایرانی در خارج از کشور و... می باشد؛ به گونه ای که محیط زیست از شمار اولویت های دولت و مردم خارج شده است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه‌گیری: از آنجا که اعمال تحریم ها موجب تنبیه دسته جمعی و فشار بر کل یک جامعه می شوند، با اصول و تعهدات پذیرفته شده مندرج در اسناد بین المللی ناسازگار است.

Impact of sanctions from the perspective of international environmental commitments with emphasis on Iran

Background and Aim: Sanctions in international law are a set of coercive measures aimed at forcing governments, international actors or Individuals not committed to the norms of international law or to follow the wishes and policies of the institution that imposes sanction. The purpose of this study is to show the consequences of international sanctions on the environment. Considering the importance of environmental protection and its integrity, the commitments of various countries and international organizations in the preservation and reconstruction of the environment, as well as the fundamental human rights recognized in international instruments and taking account of the environmental implications of sanctions; Measure their compatibility with these obligations and fundamental rights.Materials and Methods: This Research is of Theoretical Type, the Research Method is DescriptiveAnalytical, the Method of Data Collection is Library and has Been Done by Referring to Documents, Books and Articles.Findings: Imposition of sanctions on Iran has negative consequences for the environment, such as reducing government foreign exchange earnings due to restrictions on oil sales,  transfer of knowledge and technology, gasoline imports, disrupting the educational process of Iranian students abroad and..; In such a way that the environment is out of the priorities of the government and the people.Ethical considerations: In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.Conclusion: Since sanctions impose collective punishment and pressure on an entire society, it is inconsistent with the accepted principles and obligations mentioned in international instruments.Cite this article as: Saberpour A, Akhavan Fard M, Masoud Gh.
