انحراف در کشف جرم

زمینه و هدف: یکی از عوامل ایجاد اختلال در جوامع بشری جرم است. که همواره امنیت جانی، اقتصادی، سیاسی، فرهنگی انسان ها و جامعه و دولت ها را در معرض خطر قرار داده است. واکنش جوامع در مقابل این پدیده ابتدا از طریق اعمال روش ها و ابزارهای قهرآمیز قانونی با توسل به نهادهای کیفری است. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‏ باشد و روش جمع ‏آوری اطلاعات بصورت کتابخانه‏ ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.یافته‌ها: روش های ناصحیحی نیز در جهت مقابله با جرم در بین کارگزاران کیفری همانند قضات و مراجع انتظامی مرسوم است. که این روش های غیرصحیح با دو موضوع نظم عمومی و حقوق افراد مغایرت دارد. لیکن گاها نگاه توام با مصلحت و حتی خیرخواهانه، کارگزار کیفری را مجاب می نماید، که در راستای حل مساله کیفری یا پرونده به روش های غیرصحیح توسل جوید. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. نتیجه‌گیری: عدم جرم دانستن این طریق ناصحیح کشف جرم و تحصیل دلیل و عدم ذکر آن به عنوان عاملی که می‌تواند موجبات مختومه شدن پرونده را تحت قالب قرار موقوفی تعقیب فراهم نماید، یک نقیصه‌ی قانونی است که سبب تشتت آراء و عدم وجود رویه‌ی واحد در خصوص یک موضوع نزد مراجع قضایی شده است.

Deviation in crime detection

Background and Aim: One of the causes of disruption in human societies is crime, which has always endangered the lifeeconomicpoliticalcultural security of human beings and society and governments. Communities’ response to this phenomenon is primarily through the use of coercive legal methods and tools, resorting to criminal institutions.Materials and Methods: This research is of theoretical type and the research method is descriptiveanalytical and the method of data collection is library and has been done by referring to documents, books and articles.Results: Incorrect methods to deal with crime are also common among criminal agents such as judges and law enforcement agencies. These incorrect methods contradict the two issues of public order and individual rights.
