بررسی اجرای صحیح پیش فروش ساختمان در جهت تضمین حقوق شهروندان با تاکید بر قانون پیش فروش ساختمان مصوب 1389

زمینه و هدف: روند رو به رشد جمعیت و کمبود فضا در شهرهای بزرگ وجود آپارتمان نشینی را توجیه می کند ساخت و ساز آپارتمان نیز حرفه مستقل عدهای از اشخاص حقیقی و حقوقی شده است در سالهای بعد از انقلاب اسلامی نظر به افزایش جمعیت و به تبع آن افزایش تقاضای مسکن و از طرفی گران بودن زمینه ای شهری سازندگان را بر آن داشت تا بخشی از نیاز مالی خود را از طریق پیش فروش بخشی از ساخته های خود تامین نمایند همچنین کم بودن قدرت خرید متقاضیان نیز از سوی دیگر سبب تشویق ایشان به پیش خرید و پرداخت اقساطی ثمن شد همگی این عوامل دست به دست هم داد تا پدیده پیش فروش و پیش خرید آپارتمان در شهرهای بزرگ رایج گردد و شیوع پیدا کند. هدف از این تحقیق دستیبابی به راهکارهایی در جهت اجرای صحیح پیش فروش ساختمان در جهت تضمین حقوق شهروندان می باشد. مواد و روش‌ها: این تحقیق بصورت توصیفی-تحلیلی نگارش شده است. یافته‌ها: یافته ها حاکی از این است که قانون پیش فروش ساختمان مصوب 1389 با بیست و پنج ماده و چهار تبصره گامی بلند در راستای اجرای صحیح پیش فروش ساختمان در جهت تضمین حقوق شهروندان برداشته است. ملاحظات اخلاقی: مقاله پیش رو با تکیه بر اصول صداقت و امانتداری نگارش گردیده است. نتیجه‌گیری: همگام با روند  ساخت و ساز و نیاز به مسکن در جامعه مقنن نیز احساس نیاز پیدا کرد تا برای نظم بخشیدن به این قراردادها دست به تقنین و وضع قوانین سازگار با موضوع بزند از همین روی در سال 1389 قانونی به نام قانون پیش فروش ساختمان به تصویب مجلس شورای اسلامی رسید که موجب تنظیم بخشی از روابط موجود بین خریداران و فروشندگان گردید و حقوق شهروندان نیز در این قانون تضمین گردید.

Investigating the correct implementation of pre-sale of buildings in order to guarantee the rights of citizens with emphasis on the law of pre-sale of buildings approved in 2010

Background and Aim: The growing trend of population and lack of space in large cities justifies the existence of apartment living. Apartment construction has become an independent profession of some individuals and legal entities in the years after the Islamic Revolution due to population growth and consequently The increase in demand for housing and the high cost of urban land on the other hand forced builders to meet part of their financial needs by preselling some of their buildings. Also, the low purchasing power of applicants on the other hand encouraged them to prepurchase. And the payment of installments paid off. All these factors went hand in hand to make the phenomenon of presale and prepurchase of apartments common in large cities and spread is.Materials and Methods: This research has been written in a descriptiveanalytical manner.Results: The findings indicate that the law on presale of buildings approved in 1389 with twentyfive articles and four notes has taken a big step towards the proper implementation of presale of buildings in order to guarantee the rights of citizens.Ethical considerations: The present article has been written based on the principles of honesty and trustworthiness.Conclusion: Along with the construction process and the need for housing, the legislature also felt the need to legislate and enact laws compatible with the issue in order to regulate these contracts. Therefore, in 2010, a law called the Building PreSale Law was enacted. It was approved by the Islamic Consultative Assembly, which regulated part of the existing relations between buyers and sellers.
