سیاست جنایی افتراقی در جرائم غیرعمد مستوجب دیه در پرتو کثرت گرایی نظام حقوق کیفری

زمینه و هدف: سیاست جنایی افتراقی در جرم شناسی یکی از اولین جلوه های تکثرگرایی در نظام های حقوق کیفری محسوب می شود. هدف از پژوهش حاضر بررسی و نحوه اعمال سیاست جنایی افتراقی در زمینه جرائم غیرعمد موجب دیه می باشد. مواد و روش‌ها: این تحقیق از نوع نظری بوده ‌روش تحقیق به صورت توصیفی تحلیلی می‏ باشد و روش جمع ‏آوری اطلاعات بصورت کتابخانه‏ ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته‌ها: جلوه هایی از سیاست جنایی افتراقی را در طراحی و تصویب قوانین کیفری به ویژه قانون مجازات اسلامی جدید مشاهده نمود. در قوانین اخیر می توان نمونه هایی از رویکرد افتراقی قانون گذار در رسیدگی مراجع قضایی از زمان کشف تا اجرای احکام جرایم غیرعمد موجب دیه را مشاهده نمود. اما در ظاهر امر به نظر می رسد که مقررات مذکور از جامعیت لازم برخوردار نبوده و در حال حاضر نمی توان به صراحت وجود سیاست جنایی افتراقی در جرایم غیرعمد موجب دیه را تایید نمود. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت داری رعایت شده است. نتیجه‌گیری: نگاه به عالم حقوق از زاویه پست مدرنیزم و پیچیده شدن روابط تابعان حقوق باعث شده است که در عالم حقوق، شکست و انکسار ایجاد شود؛ بدین معنا که طبقه بندی های سنتی، نمی تواند روابط پیچیده فعلی تابعان حقوق را پوشش دهد. سیاست جنایی افتراقی در ارتباط با جرائم غیرعمد موجب دیه نیز از این اصل مستثنی نیست. از این منظر، نمی توان یک نظم سراسری و یکپارچه برای تمام حوزه های حقوق کیفری در نظر گرفت.

Differential criminal policy in unintentional crimes causes blood money in the light of the pluralism of the criminal justice system

Background and Aim: Differential criminal policy in criminology is one of the first manifestations of pluralism in criminal law systems. The purpose of this study is to investigate and apply differential criminal policy in the field of unintentional crimes causing diyat.Materials and Methods: This research is of theoretical type and the research method is descriptiveanalytical and the method of data collection is library and has been done by referring to documents, books and articles.Results: He observed manifestations of differential criminal policy in the design and adoption of criminal laws, especially the new Islamic Penal Code. In recent laws, we can see examples of the legislator’s differential approach in dealing with judicial authorities from the time of discovery to the execution of sentences for unintentional crimes causing diyat. However, it seems that the mentioned regulations do not have the necessary comprehensiveness and at present it is not possible to explicitly confirm the existence of a differential criminal policy in unintentional crimes causing diyat.Ethical considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.Conclusion: Looking at the world of law from the perspective of postmodernism and the complexity of the relations of the subjects of law has caused failure and refraction in the world of law; This means that traditional classifications cannot cover the current complex relationships of legal entities. The discriminatory criminal policy in relation to unintentional crimes causing diyat is no exception to this principle.
